Vol. 502 No. 1

Written Answers. - Search Warrants.

Monica Barnes

Ceist:

78 Mrs. Barnes asked the Minister for Justice, Equality and Law Reform if he is reviewing the legal standing of search warrants authorised by peace commissioners in view of the recent Supreme Court judgment that a peace commissioner's signature on a search warrant was not sufficient to establish a warrant's validity; and if he will make a statement on the matter. [7098/99]

I wish to inform the Deputy that my Department is considering the implications of the Supreme Court judgment in question and has sought the views of the Attorney General in this regard. However I should point out that a preliminary examination of the judgment would suggest that the decision is not of general application but only applies to the particular facts of the case in question.
