Vol. 503 No. 3

Written Answers. - Appeals Procedure.

Noel Ahern

Ceist:

462 Mr. N. Ahern asked the Minister for Justice, Equality and Law Reform if free legal aid is available to appeal to the courts system, a decision of the Employment Appeals Tribunal; the other options, if any, available to an ex-worker who feels aggrieved with a decision of the Tribunal; and if he will make a statement on the matter. [10180/99]

Under the Civil Legal Aid Act, 1995, the principal function of the Legal Aid Board is to provide, within the board's resources and subject to the other provisions of the Act, legal aid and advice in civil cases to persons who satisfy the requirements of this Act.

In the case of a person who wishes to appeal a decision of the Employment Appeals Tribunal to the courts system, provided that person makes an application to the Legal Aid Board for legal aid and satisfies the criteria laid down in the 1995 Act, he or she would be entitled to avail of such legal aid.

Regarding the question of the other options, if any, available to an ex-worker who feels aggrieved with a decision of the tribunal this would be a question more appropriate to my colleague An Tánaiste and Minister for Enterprise, Trade and Employment.
