Ceist:

494 Mrs. Owen asked the Minister for Justice, Equality and Law Reform if he has carried out an investigation into a complaint made to him on 30 March 1999 (details supplied); and if he will make a statement on the matter. [10073/99]

The letter from the person concerned relates to a civil legal action rising from an incident which occurred in March 1990.

A criminal investigation followed the incident and a file was sent to the DPP by the Garda authorities. The DPP directed no prosecution. In addition, disciplinary proceedings were taken against a member of the Garda Síochána. In April 1991 the member was found in breach of discipline on four counts and was fined.

The civil legal action referred to above has not yet been concluded and while this action is pending the Deputy will appreciate that it would not be appropriate for me to comment on the issues in the case.

The letter of 30 March has been referred to the office of the Chief State Solicitor and the Garda authorities.
