Ceist:

719 Mr. G. Mitchell asked the Minister for Arts, Heritage, Gaeltacht and the Islands if she will instruct that an injunction be taken against a developer who has carried out unauthorised work on public property resulting in flooding of the garden of a person (details supplied) in Dublin 12 who has resided at the address for many years without previous difficulty; and if she will make a statement on the matter. The matter to which the Deputy refers has been referred to the Chief State Solicitor's office for advice and appropriate action. The matter is being pursued with a view to having it resolved as soon as possible.

I am informed that the flooding of the garden in question may have arisen as a result of the removal of part of the rear boundary ditch from the garden and I understand that the owner has obtained the services of a solicitor to advise her in the matter.
