219 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when persons (details supplied) in County Mayo will receive 1999 cattle and sheep headage and premia. [21287/99]

The applicant in question submitted 12.10 hectares on his 1999 area aid application. Following processing of his application only 11.50 hectares were found. This represents a difference of 0.60 hectares or 5.22 per cent between the area claimed and that found on inspection. Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3 per cent, the penalty is based on double the difference when it is between 3 per cent and 20 per cent and when the difference is over 20 per cent, a 100 per cent penalty must be applied. Therefore the penalty applied is 1.20 hectares, leaving the area determined at 10.30 hectares. Any payments due will issue as soon as possible.

220 Mr. McGinley asked the Minister for Agriculture, Food and Rural Development when 1999 sheep headage will be paid to a person (details supplied) in County Donegal. [21302/99]

A payment in the amount of £970 dated 29 October 1999 issued to the person named in respect of the 1999 sheep headage scheme.

221 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 cattle headage and a suckler cow premium. [21304/99]

The applicant in question submitted 22.55 hectares on his 1999 area aid application. Following processing of his application only 16.84 hectares were found. This represents a difference of 5.71 hectares or 33.91 per cent between the area claimed and that found on inspection. Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3 per cent, the penalty is based on double the difference when it is between 3 per cent and 20 per cent and when the difference is over 20 per cent, a 100 per cent penalty must be applied. Consequently a 100 per cent penalty has been applied and the herdowner has been so informed.

222 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when persons (details supplied) in County Mayo will receive 1999 cattle headage and a suckler cow premium. [21305/99]

A herdowner must submit a valid area aid application for the relevant year in order to be considered for payment of headage grants. The person named did not submit an area aid application in 1999 and consequently no cattle headage payments can be made. Suckler cow premium payment on 15 animals will be made as soon as possible. Because entitlement is confined to 15LU no special beef premium payments can be made.

A problem has arisen in that a commonage parcel claimed by the above named has been cumulatively overclaimed by all the applicants. No payments can issue until this problem has been resolved.
