Under the terms and conditions of the scheme of early retirement from farming, payment of a pension can be authorised only from the date of receipt of a valid application. The date of receipt of a valid application is the date on which all core documentation is lodged with the local FDS office.
In this case, the application for the person named was lodged in the local FDS office on 23 February 1999. On examination of the file a number of queries arose. The applicant was requested to provide further details and the requested information was sent back 33 days later. Accordingly, the date of valid application was deemed to be 28 March 1999, 33 days after the application was lodged.
The applicant lost no payment in respect of the time that the initial application was being examined in my Department. Payment was deferred only in respect of the delay in furnishing a valid application. In the circumstances, there are no grounds for backdating the payment of the pension to the original date of application.
