98 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 headage and premia payments in view of the fact the delay in the digitising of a parcel of his land is causing him serious financial hardship. [21941/99]

As stated in my reply of 12 October 1999, this applicant changed his area declared under the 1999 area aid scheme from that which had been claimed in 1998. The changes outlined by the farmer on his map have now been entered on the Department's electronic database. Following this a dual claim has been determined on one of the land parcels claimed by the person named. Both herdowners involved have been written to in this connection. No payments can issue until this matter is resolved.

99 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 cattle and sheep headage. [21942/99]

The applicant submitted 18.04 hectares on his 1999 area aid application. Following processing of his application an area of 16.83 hectares was determined. This represents a difference of 1.21 hectares or 7.19 per cent between the area claimed and that determined. Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3 per cent, the penalty is based on double the difference when it is between 3 per cent and 20 per cent and when the difference is over 20 per cent, a 100 per cent penalty must be applied. Therefore the penalty applied is 2.42 hectares, leaving the area determined at 14.41 hectares. Any payments due will issue as soon as possible.

The persons named will be paid their full entitlement under the 1999 cattle headage scheme and a 60 per cent advance payment under the 1999 suckler cow scheme within the next 14 days.
