370 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive their 1999 suckler cow premium and cattle headage in view of the fact all documents to prove her entitlement to claim the land were submitted several weeks ago. One of the parcels claimed by the person named in her 1999 area aid application overlapped with a parcel of land claimed by another applicant. The person named was contacted in this regard and in her reply clarified the position by including a map showing the correct position. This information has now been entered on to the Department's electronic database.
The person named claimed a total of 22.40 hectares on her 1999 area aid application. Following processing of her application an area of 21.72 hectares was determined. This represents a difference of 0.68 hectares or 3.13% between the area claimed and that determined.
Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%, the penalty is based on double the difference when it is between 3% and 20% and when the difference is over 20%, a 100% penalty must be applied.
Therefore in this case a penalty of 1.36 hectares has to apply, leaving the area for payment purposes at 20.36 hectares.

The person named has already been paid 1999 cattle headage and premia but an area aid penalty of 2% was applied in view of the fact that the 1999 area aid application was received two working days after the closing date for receipt of area aid applications.
However the person named subsequently submitted a copy of his postal certificate to prove he posted his application in time for the 23 April deadline, and the late area aid penalty was withdrawn.
The person named was subsequently reimbursed the amounts deducted from his 1999 scheme entitlements on account of the area aid penalty: under the 1999 cattle headage scheme the amount of £23.14 was paid to him on 28 April 2000; under the 1999 special beef premium scheme the amount of £1.91 was incorporated into the final instalment of £12.55 and paid to him on 30 April 2000; under the 1999 suckler cow premium scheme the amount of £26.62 was paid to him on 27 July 2000 and under the 1999 suckler cow premium scheme euro compensation the amount of £1.41 was also paid to him on 27 July 2000. He has now been paid his full entitlements under each of these schemes.

The application for third year payment from the person named was chosen for pre-payment inspection. The inspection took place on 4 September and a number of breaches of the scheme conditions were identified. The applicant was advised on 22 September that these breaches had been identified and he was informed of the consequent penalties. The applicant was further advised of his right of appeal against the imposition of these penalties and his response in this regard is awaited. As the total amount of the penalties exceeded 100%, no payment can be made for the third year unless the applicant is successful on appeal.
