77 Mr. Ring asked the Minister for Agriculture, Food and Rural Development the reason his officials have not called to a person (details supplied) in County Mayo to resolve the difficulty of plots of land between him and his neighbour. [20908/00]

The difficulties with this person's plots of land related to overlaps and dual claims. These difficulties have since been resolved and the question of a visit does not now arise. There are, however, over-claims determined for this person's 1999 and 2000 area aid applications.

In 1999 the person named included 25.03 hectares in his area aid application. An area of 24.40 hectares was determined which is some 0.63 hectares or 2.58% less than the area claimed. Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%. In this case no penalty is applied leaving the area determined for payment purposes at 24.40 hectares. Any payments due based on this area have already issued.

In 2000 the person named claimed a total of 24.91 hectares on his area aid application. Following processing of his application an area of 24.12 hectares was determined. This represents a difference of 0.79 hectares or 3.28% between the area claimed and that determined. Under Article 9 of EU Regulation 3887/92, the penalty is based on double the difference when the difference between area claimed and area found is between 3% and 20%.

In this case a penalty of 1.58 hectares must apply leaving the area for payment purposes at 22.54 hectares.
