170 Mr. Creed asked the Minister for Agriculture, Food and Rural Development if a person (details supplied) in County Cork will receive cattle headage grants. [5703/01]

The application of the person named under the 2000 cattle headage scheme was received in the district livestock office on 26 June 2000. The closing date for receipt of applications was 31 May 2000, with a late application period up to and including 25 June 2000. My Department wrote to the man in question on 26 June 2000 advising him that as his 2000 cattle headage application was received after 25 June 2000, no grants would issue to him under this scheme. He was given the opportunity to have this decision reviewed by writing to my Department setting out any facts which he wished to put forward to support his case. No reply has been received to date from the person named.

171 Mr. Perry asked the Minister for Agriculture, Food and Rural Development if he will intervene on behalf of a person (details supplied) and make a decision on her 2000 equine headage application; and if he will make a statement on the matter. [5708/01]

The application period for the 2000 headage schemes including the equine headage scheme was 3 April 2000 to 31 May 2000, with a late application period up to and including 25 June 2000. The application by the person named under the 2000 equine headage scheme was received in my Department on 3 January 2001. The person named also applied under the 2000 cattle headage scheme, and the application for that scheme was received in my Department on 25 May 2000.

As the person named lodged her cattle headage application on time, it appears that the equine headage application was not lodged in time through an oversight, and soforce majeure circumstances which, under the terms and conditions of the headage schemes, apply only to the applicant, cannot be accepted on this occasion.
