254 Mrs. Owen asked the Minister for Justice, Equality and Law Reform the EU directives relevant to his Department which are awaiting implementation; the nature of the directive; when it was passed by the Council of Ministers; the final date for implementation; and if this deadline will be met. 14 March 2000Regulations to implement the provisions of the Directive will be made following enactment of the Solicitors (Amendment) Bill, 1998, which is before the House.

EU Council Directive 95/46/EC

The protection of individuals with regard to the processing of personal data and on the free movement of such data.

24 October 1998 Transposition of the Directive was delayed due to complexity involved and other legislative priorities. Drafting of the Data Protection (Amendment) Bill is well advanced and it is expected that this Bill will be published in this session.

EU Council Directive 97/80/EC

The Directive lays down the rules in relation to the evidential burden of proof in cases of discrimination based on sex. It also contains a definition of indirect discrimination on grounds of sex.

EU Council Directive 2000/78/EC

The Directive is to lay down a general framework for combating discrimination on grounds of religion or belief, disability, age or sexual orientation as regards employment and occupation.

2 December 2003.It is intended to implement the Directive within the timeframe specified. However, in order to take account of particular conditions, member states may, if necessary, have an additional period of three years from 2 December 2003, that is a total of six years, to implement the provisions of the Directive on age and disability discrimination.
