Ceist:

422 Mr. M. Higgins asked the Minister for Justice, Equality and Law Reform if he will report on the position in the deportation case of a person (details supplied); and if he will make a statement on the matter. [19776/01]

The person in question arrived in the State on 3 November 2000 and applied for asylum. It subsequently transpired that he had previously applied for asylum in Germany and accordingly Ireland applied to Germany to accept responsibility for this applicant under the Dublin Convention. On 9 May 2001 Germany accepted responsibility for the person concerned under Article 8 of the Dublin Convention. The person concerned was sent a Notice of Determination by registered post on 11 May 2001 informing him that his application for refugee status was being transferred to Germany under Article 8 of the Dublin Convention.

The person concerned appealed the determination on 21 May 2001. On 29 June 2001 the Refugee Appeals Tribunal informed the Dublin convention unit of my Department that it had affirmed the determination of the Refugee Applications Commissioner that the person concerned should be transferred to Germany in accordance with the Dublin Convention. I expect to receive the case file on this matter and make a decision on same very shortly.
