428 Mr. Stagg asked the Minister for Justice, Equality and Law Reform the new measures he proposes to take to deal with the ongoing problem of mobile merchants who trespass on private and public land in large numbers; and if he will make a statement on the matter. [19860/01]

I refer the Deputy to my reply to Questions Nos. 151, 152 and 153 of 21 June 2001 on the same subject matter. As I outlined in that reply, trespass on either public or private land falls, for the most part, to be addressed by means of civil remedy. However, there are circumstances where trespass may also be dealt with under the criminal law, and I am assured by the Garda authorities that where offences under such law are detected, appropriate action, including prosecution, is taken. Although I have no proposals at present to amend the law in relation to trespass, my Department will continue to keep the matter under review.
