337 Mr. N. O'Keeffe asked the Minister for Agriculture, Food and Rural Development if he will arrange to have a person (details supplied) in County Cork called for an oral hearing in respect of an appeal. [22199/01]

The appeal by the person named has already been considered by the REPS appeals committee. The appeal was lodged in January this year. In accordance with the normal procedures, the case was investigated and a report was prepared for the appeals committee. The committee considered this report, together with the appeal itself and decided that the penalty had been correctly applied. The person named was informed of the outcome on 12 September 2001.

The decision of the REPS appeals committee represents my Department's final position in relation to any REPS penalty.
