Written Answers. - Deportation Orders.

327 Mr. Gregory asked the Minister for Justice, Equality and Law Reform if he will support the request of school authorities for a person (details supplied) to be allowed remain here; and if he will make a statement on the matter. [31364/01]

The person referred to arrived in the State on 31 October 2000 as an unaccompanied minor and was subsequently reunited with his mother who had previously arrived in the State on 20 September 1999 and sought asylum. Following an interview, it was concluded that their application was not such as to entitle them to a declaration as refugees. They were informed of this decision on 25 April 2001. Their subsequent appeal was refused by the Refugee Appeals tribunal on 10 October 2001.

In accordance with Section 3 of the Immigration Act, 1999, the family in question was informed on 29 November 2001 that it was proposed to make deportation orders in its case. They were given the alternatives of either making representations within 15 working days setting out reasons why they should be allowed to remain temporarily in the State, leaving the State before the orders are made or consenting to the making of deportation orders. Their reply is still awaited and I expect the file to be submitted to me for consideration shortly.
