Written Answers. - Social Welfare Appeals.

Ceist:

329 Mr. Ring asked the Minister for Social, Community and Family Affairs when a person (details supplied) in County Mayo will receive full payment of disability, following the reassessment of this person's means. [4304/02]

The person concerned was awarded disability allowance with effect from 28 February 2001. He is currently in receipt of payment at the reduced rate of €96.30 per week based on weekly means of €24.42 derived from the potential rental value of his land holding. Deductions are also being made in respect of an overpayment of some €24,800 which he previously incurred on an unemployment assistance claim.

He was notified of this decision and of his right of appeal to the social welfare appeals office on 30 July 2001. He appealed against this decision on 30 August 2001 and an appeals officer has decided that an oral hearing is necessary. The appeals office will be in contact with the person concerned in this regard.

Under social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
