Vol. 548 No. 2

Written Answers. - Registration of Title.

Michael Ring

Ceist:

377 Mr. Ring asked the Minister for Justice, Equality and Law Reform if a dealing will be expedited in the Land Registry Office for a person (details supplied) in County Mayo; and when it will be completed. [4756/02]

I am informed by the Registrar of Titles that this dealing refers to an application under Section 49 – i.e. acquisition of title by virtue of long possession – of the Registration of Title Act, 1964, and a subsequent application for a transmission which were lodged on 24 June 1999. I understand that due to their complicated nature, applications under section 49, which require detailed examination of claims for registration as owners can take some time to process.

I am further informed that queries issued to the lodging solicitors on 26 September 2000. The application cannot proceed until a full and satisfactory reply to the queries raised has been received. However, I can assure the Deputy that the matter will receive further attention on receipt of a reply.

Ceist:

378 Mr. Ring asked the Minister for Justice, Equality and Law Reform the reason incorrect information was provided in Parliamentary Question No. 984 of 30 January 2002, when in fact the applicant's solicitor has contacted the Land Registry Office on at least three different occasions in 2001 to expedite a dealing for a person (details supplied) in County Mayo. [4757/02]

I can inform the Deputy that the position in relation to this case is set out in my answer to Parliamentary Question No. 989 on 30 January 2002.

I am informed by the Registrar of Titles that queries issued to the lodging solicitors on 5 January 2001 and that the Land Registry has no record of any contact by the lodging solicitors since that date.
