Michael Ring

Ceist:

195 Mr. Ring asked the Minister for Agriculture, Food and Rural Development if a person (details supplied) in County Mayo will receive a ewe premium for 2002. [13694/02]

On 13 December 2001, an application for 35 ewes was submitted in the name of the person named. Correspondence subsequently received from solicitors acting on behalf of the son of the person named indicates that he, the person named, was deceased since 1991 although applications for livestock grants continued to be made in his name since that date. The validity of those applications, including the 2002 application for ewe premium, is now being examined and a decision on payment can only be made when that examination is completed. In any event payments under the 2002 ewe premium scheme cannot commence before 16 October 2002 in line with EU regulations.

Bernard J. Durkan

Ceist:

197 Mr. Durkan asked the Minister for Agriculture, Food and Rural Development if he will review the decision made with regard to the REP scheme application in the name of a person (details supplied) in County Kildare; and if he will make a statement on the matter. [13697/02]

The person named began his REPS contract on 1 January 2000 and was subject to the arrangements governing the transition between the first REP scheme and the second one. Accordingly, he gave a written undertaking to complete the measures specified in his REPS plan over a five-year period, and to integrate and adapt that plan for the new REP scheme when it came into operation. The new REP scheme came into operation on 27 Nov ember 2000 but the person concerned never adapted and integrated his plan as he had undertaken to do.

When he applied to join REPS, the person named gave a written undertaking to repay any moneys received under the scheme if he failed to carry out his undertaking as regards transition arrangements. In light of the above, my Department must seek to recoup all the payments that the person named received under the rural environment protection scheme.

John Ellis

Ceist:

198 Mr. Ellis asked the Minister for Agriculture, Food and Rural Development if his Department will now pay suckler premiums due to a person (details supplied) in County Leitrim. [13698/02]

The person named applied for premium for 40 animals under the 2001 suckler cow premium scheme. Following an examination of the application one animal tag number BLA262584 was deleted without penalty as it had been duplicated. At inspection, one animal, tag number LEA660998 was absent as it had died prior to the application date. This resulted in this animal being rejected from the claim with a consequential reduction penalty to be applied on the 38 remaining animals. Processing of the payment has been delayed as the CMMS database was not updated with regard to the death of the animal. The person named submitted the relevant documentation on 4 June 2002 and this matter has now been finalised. Correspondence is issuing from my Department advising the herdowner that his application is now being further processed for payment on the above basis.
