Written Answers. - Use of Fireworks.

Ceist:

1409 Mr. Durkan asked the Minister for Justice, Equality and Law Reform if restrictions can be made on the use of fireworks as opposed to the purchase of same; and if he will make a statement on the matter. [17024/02]

Fireworks are deemed to be explosives in accordance with the Explosives Act, 1875. Accordingly, they may be imported into the State only under an importation licence granted by my Department and it is a long standing policy that these licences are granted only for organised displays conducted by professional and experienced operators. There are further provisions in the law in relation to, for example, the throwing, casting or firing of fireworks in or onto any street or other public place which is an offence under section 80 of the Explosives Act, 1875. Explosives legislation is under review in my Department, but further criminalisation gives rise to complex issues.
