A grant of €130,000 was allocated to the club in question under the 2002 sports capital programme, administered by my Department, towards the construction of dressing rooms. The grant was subject to the terms and conditions of the programme, among which was a requirement, in the case of a grant of more than €80,000, to legally insure for a refund of the grant in the event of the facility not continuing to be used for the purpose for which the grant was allocated. This legal agreement is invoked by my Department's legal advisers, the Office of the Chief State Solicitor. In my reply to Question No. 374 on this project on 25 March 2003, I advised the Deputy that the CSSO was awaiting a reply to a letter sent to the club's solicitor on 18 February. The CSSO is still awaiting a reply to this letter. I understand the club's solicitor in turn submitted the letter to the legal department of Dublin City Council. The CSSO is not in a position to proceed until the legal documentation requested has been supplied. Payment of the grant can only proceed when this matter is resolved.
