160 Mr. J. O'Keeffe asked the Tánaiste and Minister for Enterprise, Trade and Employment the position regarding a non-national who is working with a company under a work permit whereby the company has gone into liquidation. [16437/03]

The practice of the work permit section of my Department in regard to liquidations is that where the employee is let go and finds another job, it will facilitate the early processing of a new work permit application from the new employer. In addition, the new employer is excused from the requirement to advertise the position with FÁS in advance of making the application for the work permit. Where the business re-opens under a new owner but is otherwise unchanged the existing work permit will continue to be valid. If the company in liquidation is taken over and is incorporated into another business under a new name the new employer should apply for the work permit.
