Friday, 24 May 1985

SECTION 79.

Question proposed: "That section 79 stand part of the Bill."

Section 79 re-enacts in principle the present law, that is, section 263 of the 1857 Act which empowers the court to disallow in whole or in part any debt which has already been proved or admitted. It extends the existing section by allowing the bankrupt or the arranging debtor to apply to have a debt disallowed. At present only the Official Assignee or a creditor can do so.

Question put and agreed to.
The sub-committee adjourned at 1 p.m. sine die.
