SECTION 35.

Question proposed: "That section 35 stand part of the Bill."

There would seem to be an omission in that the Minister has not provided for consultation with the Director of Consumer Affairs when she decides to make additional provisions in relation to the form and content of credit agreements. As I argued earlier, the Director of Consumer Affairs is the mediator between consumers and lenders and his advice would be valuable to any Minister before regulations are made. While it may be a matter of course that the Minister for Enterprise and Employment would consult the Director of Consumer Affairs, if the Department of Finance took the initiative the director may not be consulted on the issue and his views would not be heard. It would seem to be good housekeeping to include such a provision.

The Director of Consumer Affairs will be consulted regularly as he will be implementing the Bill. I accept the Deputy's point, on the lines of his earlier point, and we will endeavour to tidy up the Bill and follow through on that.
