SECTION 69.

Question proposed: "That section 69 stand part of the Bill".

Section 69 (3) begins:

For the purpose of this section a statement to the effect that goods will not be exchanged, or that money will not be refunded, or that only credit notes will be given for goods returned, shall be treated as a statement to which subsection (1) refers. . . .

Is this what is contained in the Sale of Goods and Supply of Services Act, 1989, because it would appear that current practise does not comply with this provision? There are signs which indicate that goods will not be exchanged or only credit notes will be provided.

This provision is contained in the Sale of Goods and Supply of Services Act, 1989, and the kind of activity to which the Deputy refers is illegal.

That is correct.

On 23 December 1993, the Director of Consumer Affairs, William Fagan, warned, when the then sales period started, that signs such as those described by the Deputy were illegal and consumers could purchase and return, even under a sale. Where people do not comply with the regulations in this respect they can be challenged.

That is correct.
