Question proposed: "That section 64 stand part of the Bill."

This section allows for an option for indictable cases to be dealt with in the District Court rather than on indictment. This suggests that it is a minor offence. I would be tough on that.

I will look at it.

It suggests that there is a softness on these cases.

Question proposed: "That section 66 stand part of the Bill."

Under this section is a person who sells unstamped tobacco on the streets obliged to give an account of where the product was acquired when approached by a garda?

The section provides that a person reasonably suspected of an offence relating to the supply and sale of unstamped tobacco products must provide their name, address and date of birth to the officer of the Revenue Commissioners or a garda and also provide any information they may have about the goods in question.

Is it an offence if they refuse?

Failure to comply with the obligation to answer questions is punishable by a fine up to a maximum of £1,000.
