I move amendment No. 13:

In page 6, paragraph (b), line 41, after "brought" to insert "as soon as may be".

Amendments Nos. 14 and 15 are related and may be discussed together.

I move amendment No. 14:

In page 6, paragraph (b), line 49, after "remand" to insert "in custody".

I suggest we add the words "in custody" although I am not sure if they are necessary. I was advised these words might be necessary as that is the only way open to the court. People cannot be remanded on bail and the words "in custody" might tighten up the section. I am not sure if the Minister will accept this.

I am told these words are not necessary and that they could cause difficulties. For example, a person is arrested, brought before the District Court and remanded in custody for a week. During that period a person applies for and is granted bail by the High Court. When that person appears before the District Court at the end of the week for a further period of remand. I am concerned that the effect of this amendment would be to require the District Court to remand that person in custody, despite the fact that the person has already been granted bail by the High Court. That difficulty could arise from this amendment.
