177 Mr. Stagg asked the Minister for Justice, Equality and Law Reform the number of successful prosecutions brought under Section 4 of the Criminal Justice (Public Order) Act 2003 in 2006 in County Kildare; and the details of same. [21427/06]
Amharc ar fhreagraSection 4 of the Criminal Justice (Public Order) Act 2003 provides for a member of an Garda Síochána, not below the rank of Inspector, to apply to the District Court for an order to temporarily close catering premises in certain specified circumstances as defined in the Act. Section 4 of the Criminal Justice (Public Order) Act 2003 provides the procedures by which a closure order may be obtained but does not provide an offence for which a prosecution can be taken. Therefore, the question of prosecutions under section 4 of Criminal Justice (Public Order) Act 2003 does not arise.
