496 Deputy Richard Bruton asked the Minister for Justice, Equality and Law Reform if his new provisions on intoxicating liqueur public order have considered imposing a condition whereby alcohol can not be sold in premises which are operating on the basis of a planning application for retention of an unapproved use. Amharc ar fhreagraThe Government Legislation Programme provides for publication of a comprehensive Sale of Alcohol Bill later this year which will modernise and streamline all the laws relating to the sale and consumption of alcohol by repealing the Licensing Acts 1833 to 2004, as well as the Registration of Clubs Acts 1904 to 2004, and replacing them with updated and streamlined provisions.
It is intended that this legislation will clarify matters relating to the relationship between licensing law and the planning and development code. For example, the Bill will provide that a certificate entitling the applicant to obtain a liquor licence shall not be granted by the Court unless it is satisfied that appropriate planning permission for the premises concerned has been obtained and that any conditions attached to such permission have been complied with.
