1357 Deputy Michael Ring asked the Minister for Social Protection when a person (details supplied) in County Mayo will be called for a second medical assessment in order that their illness benefit appeal will be finalised. [33771/10]
Amharc ar fhreagraThe Social Welfare Appeals Office has advised me that, payment of benefit was disallowed following an examination by a Medical Assessor who expressed the opinion that the person concerned was capable of work. She has appealed this decision and in accordance with the statutory procedures the relevant department papers and the comments of the Social Welfare services on the matter raised in the appeal have been sought. In that connection an examination by another Medical assessor will be carried out on 14 October 2010. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.

Amharc ar fhreagraThe Social Welfare Appeals Office has advised me that an appeal by the person concerned was registered in that Office on 21 September 2010. It is a statutory requirement of the appeals process that the relevant Departmental papers and comments by the Social Welfare Services on the grounds of appeal be sought. When received, the appeal in question will be referred to an Appeals Officer for consideration. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
