Flood Prevention Measures

251. Deputy Terence Flanagan asked the Minister for Public Expenditure and Reform the position regarding measures to prevent flooding from the River Wad in Donnycarney, Dublin 5 (details supplied); and if he will make a statement on the matter. [6791/14]

The flood defence works on the River Wad at Donneycarney, which are being undertaken and managed by Dublin City Council as the Contracting Authority commenced in late 2013 and are currently approximately 25% complete. The main elements of the works are being carried out by the Office of Public Works on behalf of the Council using its own labour force. It is expected that the works will be completed by the end of this year, subject to the Council securing any necessary consents from property owners affected by the works.

The Office of Public Works is working in partnership with its consultants, local authorities and other stakeholders to deliver the Catchment Flood Risk Assessment and Management Study (CFRAM) Programme. This is a strategic approach that recognises the need, in line with international best practice, to move to a more sustainable, planned and risk-based approach to dealing with flooding problems.

Under the Programme, work on Draft Flood Maps will be finalised during 2014. A key element of the Programme is public consultation. It is envisaged that the draft flood maps produced under the CFRAM will be brought to formal public consultation in summer/autumn 2014. Informal Public Information Days on the Draft Flood Maps will take place also. These events will be advertised in local press and regular updates will be available on the Programme website www.cfram.ie. The draft maps will be finalised following the public consultation phase.

I also intend to speak at the British Irish Chamber of Commerce Annual Conference on Thursday 13 February 2014 in Belfast and attend a pre-conference dinner the evening before.

In July 2013, I received representations on behalf of the three groups in question applying for the use of the former Garda station in Ardagh. I responded to those representation to confirm that the property was among forty former stations that the Commissioners had identified for disposal. Ganly Walters Auctioneers have been appointed to sell the property by public auction in March 2014. If there is no interest in the public auction, the property may be considered for the purposes of an application under the community scheme.

The Commissioners of Public Works considered the proposal submitted by the association to use the former Garda station at Rathowen, County Westmeath. An assessment of the property by my officials found it to be unsuitable for assignment to the community because of the existing complexity of the shared services arrangement with a neighbouring property.

Haddington Road Agreement Implementation

I propose to take Questions Nos. 256 and 257 together.

On the introduction of the modified salary rates introduced in January 2011, persons who were recruited to the public service through direct entry competitions in the period after January 2011 and who previously worked as a public servant in a similar or analogous role had such service recognised and were not accordingly subject to the revised rates. In fulfilment of the commitments entered into under the terms of the Haddington Road Agreement, my Department recently notified Government Departments and Offices of the revised pay rates applying in respect of the relevant direct entry civil service grades coming within the terms of clause 2.31 of that Agreement.

Trade Agreements

Deputy Eric Byrne asked the Minister for Jobs, Enterprise and Innovation the position regarding the free trade agreement between Ireland and Canada; what it entails; if he will clarify a matter regarding this agreement (details supplied); and if he will make a statement on the matter. The political agreement reached on the key elements of a Comprehensive Economic and Trade Agreement (CETA) between the EU and Canada was announced on 18 October 2013 by EU Commission President Barroso and Canadian Prime Minister Harper. At present further technical discussions based on this political agreement are taking place between both sides. These technical discussions are necessary in order to finalise the legal text of the agreement. Once agreement is reached on these, the agreement will proceed for translation and for legal validation. It is anticipated that the agreement will enter into force towards the end of 2015 or in early 216.

The CETA covers virtually every aspect of economic activity, and is an extremely important one for Ireland. It is the first comprehensive trade agreement with an historically close trade and economic partner and is a landmark deal between our two transatlantic economies. When fully implemented 99% of all tariffs (duties) on goods will be removed, the vast majority of them being wiped away from the first day of implementation. It is important to note also that the existence of a Free Trade Agreement would not have any impact on the VAT treatment of imported goods.

The CETA will also widely liberalise trade in services, among others in the areas of financial services, telecommunications, energy and transport. For the first time ever, all Canadian levels of government will open up their public procurement markets above certain thresholds to European suppliers. The opportunities presented by the Agreement could add well over €200 million to Ireland’s current €2.7 billion bilateral trade with Canada, thus creating more jobs and contributing to our economic recovery.

259. Deputy Terence Flanagan asked the Minister for Jobs, Enterprise and Innovation if there are any plans to make ticket touting illegal; and if he will make a statement on the matter. [6292/14]

Ticket touting, or the resale of tickets for high-demand entertainment or sporting events at a price above their face value, is not a new phenomenon. The forms that it takes have changed markedly in recent years, however, due in particular to the emergence of online trading platforms. These changes have to be taken into account in considering whether or how to make ticket resale illegal.

First, a high proportion of ticket resales appear to be made by individuals who have bought a small number of tickets legitimately and then proceed to resell them. A study undertaken in the UK estimates that up to 90 cent of ticket resales are accounted for by resales by private sellers. It is open to question if criminalising the activities of such individuals would represent an appropriate or proportionate policy response, or would constitute an effective use of the limited enforcement resources available for consumer protection. Consumer protection legislation currently governs only transactions between businesses and consumers, and extending its scope to transactions between consumers would have major policy and resource implications.

Secondly, there are now a number of businesses that engage in ticket resale openly and, as they would see it, legitimately. The main ticketing service provider in Ireland, TicketMaster, operates a UK-based online resale platform, Get Me In, on which tickets for events in Ireland, the UK and the rest of Europe can be purchased. Secondary ticket sellers such as these contend that they serve a legitimate function in making tickets available to consumers who are willing to pay premium prices for tickets and that they do so in an above-board and transparent manner that complies with consumer protection legislation and avoids the illegality and misselling associated with black-market forms of ticket touting.

While I would not entirely rule out legislative intervention, I consider that the primary responsibility for preventing the re-sale of tickets at a price higher than their face value rests with ticketing service providers and event promoters. The terms and conditions governing ticket sales generally stipulate that unlawful resale is grounds for seizure or cancellation of the ticket. I note in this connection that the English Rugby Football Union successfully took legal action against a ticket resale website in 2012 to force it to disclose the identities of those offering tickets for resale with a view to preventing the sale of tickets to international matches at a price above their face value.

Small and Medium Enterprises Supports

Anyone interested in starting or expanding their own business should in the first instance contact their local County and City Enterprise Board (CEB). The CEBs support the indigenous micro-enterprise sector in the start-up and expansion phases and stimulate enterprise potential at local level. They are the first port of call in terms of advice, direction, training and grant support for anyone who wishes to start or expand a business. Contact details for the CEBs are available on www.enterpriseboards.ie.

The CEBs generally only grant assist enterprises in the manufacturing or internationally traded services sector, which over time can develop into strong export entities and graduate to the Enterprise Ireland portfolio. Retail enterprises are ineligible for direct financial support from the CEBs due to concerns over displacement (where grant-assisted projects simply displace business from other players in the local market). However, any business can use the CEBs as a gateway to accessing finance from Micro Finance Ireland, which offers support in the form of loans of up to €25,000 to start-up, newly established or growing microenterprises employing less than 10 people with viable business propositions that do not meet the conventional risk criteria applied by the banks.

The Fund has a significant entrepreneurship focus and is open to anyone with a viable business proposal. Applications for the Microfinance Fund should be channelled through the local CEB. In addition, locally trading businesses, including start-ups can avail of non-financial assistance from their CEB in the form of a wide range of business advice and information services, management capability training and development programmes, e-Commerce training initiatives etc. Training courses include such topics as internet marketing, ideas generation and negotiation skills.

The Deputy may wish to note that the system for delivery of State supports to micro and small enterprises is being reformed and that the 35 existing County and City Enterprise Boards (CEBs) will be dissolved and new Local Enterprise Offices (LEOs) will be created. This reform will bring about a new level of engagement and interaction at both national and local level in relation to enterprise support and economic recovery and growth. The target date for the legal dissolution of the CEBs and the formal launch of the LEOs is mid-April, 2014. Issues relating to rates are a matter for my colleague Deputy Phil Hogan, Minister for the Environment, Heritage and Local Government.

This specific factory, which was established in 1989, employed 360 staff in 2008, but was closed on a phased basis in 2008-2009. A new parent company had acquired the facility in 2006 and, following a review by the company of its international operations, that analysis led the company to decide to close this factory and transfer production to another facility within that group, located in Costa Rica. That plant in Costa Rica had spare capacity and had cost competitive advantages over the County Wicklow operation.

Prior to this decision, IDA had engaged with the company in an attempt to secure its future but this was not possible. As you will appreciate, the ultimate decision in such cases is made by the parent company, on strictly commercial grounds, and on what is seen by the company as being in the best interests of the group as a whole. Following the decision, the relevant State bodies, Enterprise Ireland, the Wicklow County Enterprise Board (CEB) and FÁS were involved in providing advice, assistance and other supports. IDA continues to pursue the attraction of new industry for County Wicklow.

The Forfás Annual Employment Survey reports on the number of jobs gained and lost in the enterprise development agencies. The survey is conducted on an annual basis and aggregated at county level. I am informed by IDA Ireland that these figures are only available for the 10 year series 2004 to 2013. I am also informed that the 10 year series can change on a year by year basis reflecting the movement in the IDA Ireland and Enterprise Ireland portfolio of companies. Details of the number of new jobs created, on a county by county basis, in IDA Ireland supported companies in each of the 10 years from 2004 to 2013 is set out in the attached tabular statement A.

The cost per job sustained (CPJS) is the measure used by IDA Ireland to assess the cost effectiveness of various IDA Ireland grant programmes. It is not broken down on a county by county basis. The figure is calculated by taking into account all IDA Ireland expenditure to all firms in the period of calculation. Only jobs created during and sustained to the end of each seven-year period are credited in the calculations.

The latest figures for the cost per jobs sustained are contained in the Forfás Annual Employment Survey 2012 and are set out in the following tabular statement B. The cost per job sustained reduced in the period 2002-2008 arising from the strong employment performance of the FDI sector over the period. The slight increase in the CPJ over the period 2009-2010 primarily related to the reduced performance of the FDI sector particularly in 2009 where the economy experienced a significant number of job losses. This was heavily influenced by the global economic and financial environment. I am glad to be able to point out to the Deputy that this figure has begun to fall again due to improved economic performance in the FDI sector. The figure for each seven-year period is calculated by dividing the total number of jobs created by the total amount of money spent.

Deputy Dara Calleary asked the Minister for Jobs, Enterprise and Innovation if his attention has been drawn to the fact that the recent decision of the US House of Representatives overwhelmingly to support a Bill (details supplied) that specifically prohibits the US Public Company Accounting Oversight Board from introducing the types of measures that will be imposed in the EU by the Commission proposals for a regulation on specific requirements regarding statutory audit of public interest entities; if he is further aware that the Canadian Public Accountability Board and CPA Canada issued a report in May last which included a finding that the mandatory rotation of audit firms or mandatory retendering of the audit would not contribute to the enhancement of audit quality and that the UK Competition Commission in a report issued in July last also opposed the concept of mandatory audit firm rotation; if he will indicate the basis on which he and his Department have taken a line that contradicts so many international authorities in this area; and if he will make a statement on the matter. These draft audit measures are currently in the process of adoption by the EU Institutions, following which they will require to be given effect by Member States. In these circumstances, it is unclear as to the purpose to be served either by an extrapolation of costs based on estimates in the EU Commission documentation which accompanied its original proposals, which differ significantly from those which emerged from the process of negotiation, or of referral to the Oireachtas Committee on EU Affairs on the basis indicated. Obviously, it is open to the Committee in question to examine such matters within its purview as it considers appropriate.

It is difficult to envisage that graduate or other recruitment to the audit profession will be adversely affected by these audit proposals, in particular as enhanced audit provisions are entailed. The differing points of view regarding these audit proposals are moot at this point, as are positions adopted in other non-EU jurisdictions, in a situation where the focus required is on making the necessary arrangements to give effect to the EU measures when enacted. In this connection, the Department will be consulting with all of the stakeholders shortly after the adoption by the EU of the instruments in question.

The UK Competition Commission in October 2013, having confirmed that competition is restricted as regards the supply of audit services to large companies there, published measures to open up the UK market to greater competition. One of these is a requirement that FTSE 350 companies must put their statutory audit engagement out to tender at least every ten years. This is consistent with the provisions of Article 33 of the draft Audit Regulation relating to the duration of the audit engagement. Officials of my Department appeared before the Oireachtas Joint Committee on Jobs, Enterprise and Innovation on 16 October and 18 December 2012 for the purpose of its scrutiny of these EU audit proposals.

Arising from the scrutiny process, the Joint Committee wrote to the EU Commission and the EU Parliament in the matter on 15 March 2013, remitting its report and a political contribution on the audit proposals, stating that the Joint Committee “Concludes that reform of the audit sector is necessary in the context of the recent past and therefore welcomes, in broad terms, the Commission’s proposals”. As regards the issue of auditor rotation the Joint Committee stated that it “Supports the concept of mandatory rotation of auditors to ensure independence in the performance of the function and the avoidance of any perception of long-term closeness between client and auditor.”
