Departmental Staff Expenses

Deputy Niall Collins asked the Minister for Social Protection if she will provide, in tabular, form the total amount spent per annum from 2011 to 2013, inclusive, and to date in 2014 on staff subsistence payments and staff taxi payments; if her Department has been audited for tax compliance on these payments and other benefits-in-kind; if these processes have been revised in view of concerns by the Revenue Commissioners over practices in other State bodies; and if she will make a statement on the matter. Staff in the Department are paid travel and subsistence expenses where such costs are incurred wholly and exclusively in the course of a person’s business. This does not attract benefit in kind. Travel and subsistence expenses are paid in accordance with Civil Service rules and regulations. Where taxi costs are paid in the normal course of business they are not subject to benefit in kind and the Department does not pay other than for a person’s work. Given the nature of the Department’s business significant numbers of staff incur travel and subsistence expenses in carrying out their duties.

Currently the Department makes no payments that are subject to BIK. In 2011 and 2012 BIK payments were made to staff working in the IS Services area in respect of mileage. These were paid through the Department’s payroll and were subject to PAYE and PRSI deductions. These allowances were reviewed in 2012 as part of the review of all allowances requested by the Department of Public Expenditure and Reform (DPER) and as a result these allowances were withdrawn on 31st December 2012.

No tax compliance audits have or are being conducted.

The Social Welfare Appeals Office has advised me that an appeal by the person concerned was registered in that office on 24th April 2014. It is a statutory requirement of the appeals process that the relevant Departmental papers and comments by the Deciding Officer on the grounds of appeal be sought. When these papers have been received from the Department, the case in question will be referred to an Appeals Officer who will make a summary decision on the appeal based on the documentary evidence presented or, if required, hold an oral appeal hearing.

While building regulations do not require the provision of public toilet facilities in DSP public offices, the Department endeavours, where possible, to provide a fully accessible toilet facility for customer use in our public offices. Nevertheless, physical space limitations and/or structural constraints often mean that the retrofitting of a public toilet facility in existing offices can be rendered impractical, both in terms of cost and the disruption to services likely to be caused by the works.

Disability Allowance Applications

The application, based upon the evidence submitted, was refused on medical grounds and the person concerned was notified in writing of this decision on 14 March 2014.

The person in question requested a review of this decision and submitted further medical evidence in support of his application. The person concerned can expect a decision on the review of his disability allowance application shortly.

In the meantime, if his means are insufficient to meet his needs he may apply for means-tested supplementary welfare allowance from his local community welfare service.

Black Economy

Broughan asked the Minister for Social Protection further to Parliamentary Question No. 333 of 10 June 2014, if she will provide further details of the results of inspections and operations undertaken in 2013 and 2014 in the construction sector and especially construction projects where public procurement is involved and once-off builds, with particular explicit focus being given to projects under the education capital programme; and the actions taken by officials from her Department as part of these specific inspections and operations. In conjunction with Revenue, the Department undertakes site visits and inspections in the construction sector including public procurement projects. Joint Investigation Units are in operation. This Department, Revenue and NERA also actively engage with the Department of Education & Skills on education capital projects on an on-going basis.

Furthermore, the Department of Education & Skills has appointed Contractors Administration Services (CAS) to conduct random audits on school building projects to verify compliance with the relevant pay and conditions clauses in the Public Works Contracts. In addition to random audits, CAS carries out audits of employment records on a number of projects.

Should irregularities be uncovered in terms of non-compliance with pay and conditions, inspection and enforcement falls under the remit of NERA.

Should an audit uncover any other matters of concern regarding tax compliance or social welfare fraud, such matters are referred to either the Revenue Commissioners and/or the Department of Social Protection, as appropriate.

Separate to this process, the Department’s Special Investigation Unit, in conjunction with Revenue and NERA, has identified all school projects under the programme and when they are scheduled to commence. A number of site inspections have already been undertaken and further site visits and inspections are planned throughout the duration of this capital programme.

The Department cannot, for a variety of operational reasons, comment on the outcome of individual cases or investigations.

Exceptional Needs Payment Eligibility

Family Income Supplement Applications

Family Income Supplement (FIS) is a weekly tax-free payment payable to employees with children.

In order to qualify a person must have a least one qualified child who normally lives with them or is part of a family supported by them. They must also have an average net weekly family income below a certain amount for the individual family size. FIS is then calculated at 60% of the difference between the average net weekly family income and the income limit for the family size concerned.

Once the level of FIS payment is determined, it continues to be payable at that rate for a period of 52 weeks, provided that the person remains in full-time employment. Claimants who apply for a further 52 weeks have their income re-assessed and their FIS entitlement re-calculated accordingly.

There has been a steady growth both in the number of families supported by FIS over recent years and associated expenditure as set out in the following table.

Expenditure on the FIS scheme is estimated to be €281.7 million in 2014, up €20 million on 2013.

The Department avails of every opportunity in its engagement with employers and jobseekers to build awareness of the availability of FIS and how this payment may benefit potential employees with children. The increasing numbers of families in receipt of FIS is testament to the effectiveness of the Department's information strategy for the scheme and the significant improvements in customer service and processing times for FIS customers.

With the increased customer base on FIS and the continued increase in FIS new claims, the Department, in order to maintain good customer service and ensure the efficient use of its resources, proposes to continue payment of FIS for a further 52 weeks at the existing rate in the cases of some renewals where the Department's data indicates that entitlement has not varied from the previous year. As it is possible that there could be other changes in circumstances of which the Department may not be aware, claimants are being asked to contact the Department if they feel that their circumstances have changed. In these cases, the Department will carry out a full review of circumstances and issue a revised decision where warranted.

Social Welfare Fraud Investigations

Broughan asked the Minister for Social Protection further to Parliamentary Question No. 332 of 10 June 2014, the number of persons investigated for cross-jurisdictional fraud as part of the Cross-Border Operational Forum operating under the memorandum of understanding in the years 2012, 2013 and to date in 2014; and if there are any figures available on the level of Exchequer savings achieved as part any such investigations. The Cross Border Operational Forum comprises of senior fraud managers from the Republic of Ireland, Northern Ireland and the United Kingdom. The Forum’s remit is to ensure that effective co-operation takes place at an operational level to prevent and detect fraud between the three jurisdictions. Case by case co-operation takes place between fraud investigators from all three jurisdictions. The Forum does not record the outcome of cases investigated by individual officers.

In 2013, approximately 4,500 checks were carried out by the Department of Social Development (DSD) Northern Ireland on behalf of the Department of Social Protection (DSP) and 2,942 checks were carried out by the DSP on behalf of the DSD. However, it is important to note that these cases may be in order when checked and, therefore, may not be an indicator of fraud.

This application has been forwarded to one of the Department’s Medical Assessors for their medical opinion. Upon receipt of this opinion, a decision will be made and notified to the person concerned. It can currently take 12 weeks to process an application for DCA.

I propose to take Questions Nos. 371, 377 to 380, inclusive, and 383 together.

Table 1 gives the number of JobBridge interns on Jobseekers Allowance and Jobseekers Benefit by age and payment amount as requested.

Comprehensive guidance for host organisations is provided on the JobBridge website (www.jobbridge.ie). This guide answers questions such as: What is the JobBridge and National internship Scheme?, Is my Organisation Eligible?, How do I register as a Host Organisation?, What are the legal requirements of a Host Organisation?, What if the Internship is not working out as expected?, in addition to a series of toolkits including ‘Elements of a good internship’, ‘A guide to a good induction programme’, ‘Mentoring Guide’, ‘Effective Coaching and Listening’, and ‘A guide to creating a reference’.

The JobBridge General Guidelines (Nos. 8 and 9) provide that the host organisation’s public/employers liability insurance will cover an intern during the internship.

The Department intends to use the developmental internship, as specified in the Youth Guarantee, as a means of activating and supporting young unemployed people who are the most disadvantaged and most distant from the active labour market. The target cohort are people aged 18-25, with low levels of education and, who may have experienced long periods of unemployment and possibly have additional barriers to employment.

While many elements of the existing JobBridge Scheme will be utilised for this developmental internship, due to the barriers that many of these young people face, additional supports will be provided to assist them complete their developmental internship and to ultimately transition into employment.

The approach to recruitment and candidate preparation will be changed specifically to reflect the needs of these young people. It is intended that employers will offer a number of positions and the Department will select and refer the candidates. This is different to the wider JobBridge scheme, which sees internships publicly advertised and jobseekers competing through open application for these positions.

Interns will receive preparatory training before they commence an internship that will prepare them for the work environment and during the internship, training needs specific to the intern will be identified and delivered.

The variant scheme will see the Department dedicate extensive resources to the young jobseekers involved, and in the context of a guaranteed offer, the standard of mutual commitment must be higher.

In relation to outstanding material requested in earlier Parliamentary Questions detailed above, I am pleased to say that a reply has issued directly to the Deputy.
