School Staff Appeals Mechanism

570. Deputy Brendan Griffin asked the Minister for Education and Skills further to requests since early 2012 from this Deputy, if she will include severe geographic isolation and impossibility of amalgamation with another school because of distance as a grounds for appealing a mainstream teacher allocation for two, three and four teacher schools; and if she will make a statement on the matter. An appeals process is available to small schools affected by the 2012 budget change. The appeal mechanism has been made available to all types of small school and this mechanism has been based on objective enrolment data. A school with four classroom teachers or less which is losing a teacher or failed to gain an additional teacher as a result of the Budget 2012 measures can submit an appeal to the Primary Staffing Appeals Board. Details on the appeals process are made available in the staffing schedule for the current school year. The Appeals Board operates independently of the Department and its decision is final.

If geographic isolation was to be included as an appeal criterion, it would be challenging to provide an objective definition of geographic isolation that would be generally acceptable. Such an objective definition would have to be devised and agreed in the interest of running an equitable appeals process.

The Government recognises that small schools are an important part of the social fabric of rural communities. They will continue to be a feature of our education landscape. However, this does not mean that small schools can stand still or never have their staffing levels changed to something that is more affordable and sustainable for these difficult and challenging times.

The staffing arrangements for the 2015/16 school year will be published on the Department website in early 2015.

School Transport Provision

Bus Éireann, which operates the school transport scheme on behalf of my Department, is responsible for the planning and timetabling of school transport routes.

School transport is provided on the basis of a co-ordinated school calendar, agreed amongst schools that rely on the same network of bus services. My Department is reviewing the services in question with Bus Éireann and will be in contact with the Deputy directly on the matter.

School Enrolments

Deputy Éamon Ó Cuív asked the Minister for Education and Skills if she will increase the first year intake to a school (details supplied) in County Galway to 210 in 2015 to accommodate all the applications for places in the school from the catchment area and to facilitate the school accepting all the students who have applied to attend the school next year and that fall into category one and two of the school’s enrolment policy; and if she will make a statement on the matter. I wish to advise the Deputy that my Department met with the school Patron and school authority earlier this year to discuss the matter of 1st year pupil enrolments. The Patron and school authority agreed to monitor enrolments to stay within the planned capacity of the new school building which, when completed, will cater for 1,000 pupils. Given that the school will offer a transition year in due course, an enrolment of 210 first year places per year would lead to an overall enrolment of up to 1,260 pupils once the school has developed up to 6th year. It will therefore not be possible for the school to offer 210 first year places in September 2015.

The Department must preserve a balance between enrolments in schools in an area and adjacent areas and is satisfied that there are sufficient school places to meet the demand in the area in question. This may sometimes, however, lead to pupils not being offered a place in their school of first preference.

The criteria used for the allocation of teachers to primary schools is published annually on the website of the Department of Education and Skills.

The key factor for determining the level of staffing resources provided at individual school level is the staffing schedule for the relevant school year and pupil enrolments on the previous 30 September.

The staffing arrangements provide for a reduced enrolment required for the retention of the first and second classroom teaching post in an island school, where the school is the only remaining primary school on the island. Details of the staffing arrangements for the 2014/15 school year are contained in Circular 0007/2014 and is available on the website.

Student Grant Scheme Applications

The Deputy will be aware that under the terms of my Department's Post Primary School Transport Scheme, children are eligible for transport where they reside not less than 4.8 kilometres from and are attending their nearest education centre as determined by my Department/Bus Éireann, having regard to ethos and language.

Bus Éireann which operates the school transport scheme on behalf of my Department has advised that there are two services operating to the school from the area referred to by the Deputy.

Bus Éireann has advised that the child is eligible for transport. Given that the family was late in submitting payment details, all seats on the service, availed of by the child in previous school years, had by that time been allocated. As a consequence, the child was issued with a ticket for the second service operating to the school.

Student Grant Scheme Eligibility

An appeal has not been submitted by the student to the Student Grant Appeals Board.

Special Educational Needs Service Provision

Deputy Michael Ring asked the Minister for Education and Skills when a reply will issue from the special education section of her Department on a policy matter query which is outside the remit of the National Council for Special Education in view of the fact that the query has been ongoing for some time; and if she will make a statement on the matter. I wish to advise the Deputy also that the policy of my Department is to secure the maximum possible level of inclusion of students with special educational needs in mainstream primary and post-primary schools, in order to ensure that as many children as possible can be educated with their peers within their own community, regardless of their domiciliary status.

My Department provides for a range of placement options and supports for schools which have enrolled pupils with special educational needs in order to ensure that, wherever a child is enrolled, they will have access to an appropriate education.

Children with special educational needs may be enrolled in a mainstream school and attend all mainstream classes and receive additional teaching support through the learning support and/or resource teacher. If they have assessed care needs they may be supported by a special needs assistant.

In respect of children who cannot be accommodated in mainstream education, they may be enrolled in special classes or special schools where more intensive and supportive interventions are provided.

As such, a pupil may have access to a number of different placement options in a locality. However, the enrolment of a child to a school is a matter in the first instance for the parents of the child and the Board of Management of a school. My Department has no role in relation to processing applications for enrolment to schools.

The National Council for Special Education (NCSE) Special Education Needs Organisers (SENOs) can assist parents to identify appropriate educational placements for children with special educational needs.

Parents may contact their local SENO directly to discuss their child's special educational needs and to seek assistance in identifying placement options, using the contact details available on www.ncse.ie. The SENO can also advise parents in relation to supports which may be available to support children with special educational needs, including special transport arrangements which may be made available.

The NCSE has published a Guide for Parents and Guardians of Children and Young People with Special Educational Needs on Choosing a School. This guide is also available at www.ncse.ie.

Student Grant Scheme Eligibility

The changes to the eligibility criteria for the student grant scheme for the academic years 2013/14 and 2014/15 are outlined as follows. 2013 Student Grant Scheme for the 2013/14 academic year

The changes to the eligibility criteria are summarised as follows:

- Budget 2013 provided for a 3% reduction in the income thresholds used when calculating entitlement to student grants in the 2013 grant scheme. The measure applied to both new and renewal students. The reduction in thresholds did not apply to the special rate of grant or the threshold for the €2,000 contribution at postgraduate which remained at €31,500 for the 2013/14 academic year. The reduced thresholds will be reflected in Schedule 1 of the 2013 Scheme;

- The eligibility criteria for the special rate of grant was amended to introduce a provision to combine periods of Jobseeker's Allowance and Jobseeker's Benefit with the period of Maternity Benefit provided a period of Jobseeker's Allowance or Jobseeker's Benefit comes directly before and directly after the period of Maternity Benefit;

2014 Student Grant Scheme for the 2014/15 academic year

The changes to the eligibility criteria of the Student Grant Scheme are summarised as follows:

- Aftercare was included as an eligible payment for the special rate of grant and as an income disregard for the purposes of calculating reckonable income;

- Payments made to individuals by Caranua for support services are included as an income disregard for the purposes of calculating reckonable income;

- Eligibility for continuing postgraduate students to continue to receive the full fee award for the second or subsequent years of their course where it is established that all other special rate conditions are satisfied on renewal was introduced;

- For the special rate of grant, introduced the combining of periods of eligible payments with the period on JobBridge provided a period on an eligible payment comes directly before and directly after the period of JobBridge;

2014 Student Support Regulations for the 2014/15 academic year

The changes to the eligibility criteria of the Student Support Regulations are summarised as follows:

- Provision made in the Student Support Regulation 2014 to prescribe for persons awarded subsidiary protection under European Union (Subsidiary Protection) Regulations 2013 (S.I. No. 426 of 2013).

School Accommodation

As the Deputy is aware, my Department's over-riding objective is to ensure that every child has access to a physical school place and that our school system is in a position to cope with increasing pupil numbers. This can necessitate the use of temporary accommodation, as in the case of the school referred to by the Deputy, until my Department is in a position to provide a permanent building.

While the school's existing accommodation is being upgraded, the pupils have been temporarily relocated to a building that will host the establishment of a new post primary school in September 2015. The school will return to its former school building when the upgrading works have been completed. The arrangements for this relocation were made by the ETB in consultation with the school, including the parent representatives. My Department has also sanctioned funding for two additional prefabricated units to cater for increased enrolments.

My Department will continue to liaise with the school authorities regarding the school's long term accommodation needs.

Chuir 1.5% den fhoireann riaracháin in iúl go raibh ardleibhéal inniúlachta sa Ghaeilge acu agus chuir 8.7% den fhoireann in iúl go raibh meánleibhéal inniúlachta acu.

De bharr an chineál oibre atá ar bun ag an Roinn tá ardleibhéal inniúlachta sa Ghaeilge ag cuid mhór den fhoireann ghairmiúil ar nós cigirí scoile agus síceolaithe oideachais. Ag an mbunleibhéal, cuireann an Chigireacht seirbhís dhátheangach chigireachta ar fáil do na scoileanna aitheanta go léir, scoileanna Gaeltachta agus Gaelscoileanna san áireamh. Vocational Education Committees Expenditure

The accounts of VECs, including Co. Cork VEC, are audited by the Comptroller and Auditor General and I understand that the 2011 accounts of Co. Cork VEC will be completed in the near future. Once finalised, officials of my Department will arrange for them to be laid before the Houses of the Oireachtas at the earliest opportunity.

Schools Building Projects Status

The school to which the Deputy refers is to be delivered as part of the Schools Bundle 5 PPP project. This bundle comprises one primary school, four post primary schools and one Institute of Further Education.

The site acquisition process for the school in question is underway, however, due to commercial sensitivities associated with property acquisitions generally, I am unable to provide further information at this time. The planning documentation is almost complete and this will be lodged as soon as my Department is in a position to do so.

The school is currently scheduled to start construction next year.

School Enrolments

While it is intended that the school to which the Deputy refers will be located in the North Wicklow area, the school is being established to meet a demographic demand in the Bray, Kilternan and Ballbybrack/Shankill school feeder areas. Priority in the school's enrolment policy will be required to be given to pupils from those areas. It would be expected that this will be reflected in the School's enrolment policy when this is decided and published by the Board of Management and Patron in due course.

Detailed estimated costings have been received for the proposed works. These are being assessed and when this assessment is complete the Department will engage with Galway County Council regarding the timeframe and methodology for the completion of the works.

It is anticipated that the required works can be carried out early in the new year.

The Department of Education and Skills has in the Shared Services Plan for 2014 – 2016 committed to an extensive programme of reform which includes projects for Higher Education, the schools sector, SOLAS and the Education and Training Boards (ETB's) and the Department and its agencies. The Department is also participating in the Civil Service Shared Services projects for HR, Payroll, and Finance, the costs of these initiatives are managed by the Department of Public Expenditure and Reform.

A number of the Departments initiatives are Centres of Excellence which improve the management information within the sector or provide central processing but are not initiatives which are expected to generate cost savings in their own right.

My Department provides funding to local authorities for various social housing supports, including for adaptations and extensions to the social housing stock to meet needs of tenants with a disability or to address serious overcrowding.

The administration of this funding is a matter for each local authority to manage. My Department has no role in individual cases.
