Flood Prevention Measures

91. Deputy Pearse Doherty asked the Minister for Public Expenditure and Reform if he will provide an update on the development of new flood defensive measures for Donnycarney, Dublin, and the Coast Road at Clontarf, Dublin 3. [22832/15]

Works in Donnycarney (River Wad) and the Coast Road at Clontarf are being progressed by Dublin City Council (DCC), and the Council, in the first instance, is best placed to provide the most up to date information and details on progress with those works.

I am advised that the portion of Phase 1 of the flood relief works in Donnycarney which includes defences for the Clanmoyle and Donnycarney areas is almost complete. The remaining work involves the completion of Mechanical & Electrical contracts, which DCC hope to close out later this year. The Council has indicated that the remaining works under Phase 1, which comprise a tunnel under the Howth Road and an additional sea outfall for the Wad river on the Clontarf Road, are scheduled for 2016-2017 subject to the availability of the necessary funding.

A preliminary feasibility study of Phase 2 of works in the Donnycarney area, which examines the option of providing defences for Collins Avenue East, the Malahide Road at Donnycarney and at Collins Park, has been completed and this will be assessed by the Council.

It is understood that DCC has commenced works on a cycleway and new watermain from the Causeway to the Wooden Bridge in Clontarf which also incorporates a flood defence element for this location. The Council has also appointed consultants to undertake tide level and wave analysis along Clontarf Road which may result in new flood defence proposals for this area. I am further advised that subject to new options proving feasible, the Council intends to embark on public consultation with residents and business groups and subject to any proposals being favourably received, the Council would intend then to proceed to planning.

Flood Relief Schemes

Local flooding issues such as the one referred to in the Deputy's question are a matter for the Local Authority to investigate and address in the first instance. Limerick County Council may carry out flood mitigation works using its own resources.

The Office of Public Works (OPW) operates a Minor Flood Mitigation Works and Coastal Protection Scheme. The Scheme was introduced by the OPW in 2009 to provide funding to local authorities to undertake minor flood mitigation works or studies to address localised flooding within their administrative areas.

It is open to the Council to submit a funding application under the Scheme for flood protection works. It should be noted that the maintenance of river channels is not eligible under the Minor Works programme. Any application received will be considered in accordance with the scheme eligibility criteria, which include a requirement that any measures are cost beneficial, and having regard to the overall availability of resources for flood risk management.

No application for a project in relation to the Ahacronane River has been submitted to the OPW to date by the Council.

Public Sector Staff Recruitment

The Public Appointments Service (PAS) is the centralised recruitment body for the civil and public service established on an independent, statutory basis.  Through its selection competitions PAS establishes panels of suitably qualified individuals from which vacancies in the civil and public service may be filled.

The specific information requested on clerical officer panels needs to be collated and presented in a format which would answer the Deputy's question. PAS have informed my Department that it has not been possible to have the relevant information provided in that format within the timeframe available in this instance.  PAS have, therefore, undertaken to forward the information directly to the Deputy as soon as possible.

Departmental Staff Redeployment

Deputy Catherine Murphy asked the Minister for Public Expenditure and Reform if he will respond to the case of a person (details supplied) who applied in 2001 for an interdepartmental transfer under a previous set of central transfer scheme guidelines but who was required to conform to new standards put in place days after she had made the initial transfer application and, as a consequence, has not been able to avail of the transfer options available to her in the intervening period; and if he will make a statement on the matter. The Central Transfer Scheme (CTS) for Clerical Officers was negotiated with the Staff Side Unions in 1978.  It provides for cross-Departmental transfer arrangements and is a mechanism for filling clerical vacancies in provincial locations.

Each department with provincial offices maintains a list, in order of the application date, of clerical staff who are seeking a transfer.  The scheme is central in the sense that a department must accept applications from officers of other departments.  When an officer's place is reached on a list, the officer is normally considered for transfer unless his or her sick leave has been excessive. 

It is important to note that each Department maintains its own list. Based on the information supplied and the fact that there is no one centralised list  the information requested could only be provided by the officer's Department. I would advise the Deputy to contact the Officer's Department directly.

Fiscal Policy

The Spring Economic Statement (SES) outlined that fiscal space of the order of €1.2 to €1.5 billion is expected to be available for Budget 2016. The fiscal projections contained in the SES and the Stability Programme Update (SPU) are based on a technical assumption of a budgetary package of €1.2 billion in 2016, split evenly between expenditure increases and tax reductions. 

Post 2016, the fiscal forecasts included in the SES and the SPU, and all related general government expenditure ratios, reflect a no-policy-change scenario from an expenditure perspective, other than provision being made for a €300 million increase in gross voted expenditure per annum to offset demographic pressures. 

This no-policy change scenario would result in the pace of structural adjustment in the period 2017 to 2020 significantly exceeding the minimum annual rate of greater than 0.5 per cent of GDP required under the preventive arm of the Stability and Growth Pact (SGP).  However, it is the Government's firm intention - stated clearly in the SES - to make only the minimum adjustment required under the rules of the SGP in these years, which means that additional fiscal space will be available. 

Decisions regarding the application of this fiscal space will fall to be taken each year, as part of the Budget, taking account of the prevailing economic conditions and Government's commitments to investing in public infrastructure and services. As these resource allocation decisions are made by Government, the ratios in relation to general government expenditure will adjust accordingly.

The Medium Term Expenditure Framework, with multiannual ceilings, was introduced in 2011 during a period of significant fiscal consolidation and has been very successful in assisting Government to meet its fiscal targets each year.  Working within this framework, the Government has been able to achieve its fiscal targets and also allocate additional resources to areas of priority as these became available. 

The Medium Term Expenditure Framework operates within the broader context of the SGP, in particular the Expenditure Benchmark. The recent refinements in relation to the application of the Expenditure Benchmark now allow calculations of the reference rate for potential expenditure growth to be updated annually. This ensures that the rules take account of the most up-to-date outturn and outlook for potential GDP growth. This change has resulted in some 0.4 per cent of GDP in additional fiscal space in 2016. With an annual update to the Expenditure Benchmark reference rate, it is reasonable that the expenditure ceilings should be revised to take account of the most up-to-date data.

After the acquisition was agreed by the parties involved, the Competition Authority received a notification on the 16th March 2012. Following this, notification of the proposed transaction was sent to me, as Minister for Jobs, Enterprise and Innovation, in accordance with Section 23(1)(a) of the Competition Act 2002 on the 20th March 2012 as the Competition Authority considered it to be a media merger within the meaning of that Act.

The Merger Notification Form I received contained information that followed the format specified for such transactions by the Competition Authority at the time. As to be expected, reference was made to the Share Sale Agreement between Siteserv plc and Millington Ltd.

The Competition Authority's Phase 1 examination of the transaction from a competition perspective and on the basis of available evidence led it to a Determination that the proposed transaction would not lead to a substantial lessening of competition in the State. That Determination was notified to me on the 21st May 2012.

The only function of the Competition Authority, the Minister for Jobs, Enterprise and Innovation and the Department of Jobs, Enterprise and Innovation was in respect of the effect on this market of this transaction as set out in the legislation, and no examination or briefing was provided on any aspects of the transactions or the companies involved. To have done otherwise would have been to act outside their powers.

I agreed with the advice from my officials and on the basis the transaction was allowed to proceed.

I can advise the Deputy that remuneration of the staff of my Department is as sanctioned by the Department of Public Expenditure and Reform in line with Government policy.

The annual additional salary cost to my Department of introducing a minimal threshold at the figure of €11.45 per hour is estimated to be €29,195.36 per annum based on current figures for 17 staff employed at Services Attendant and Cleaner grades.

I have asked all Agencies under the aegis of my Department to advise me of the relevant information, and I will communicate that information to the Deputy as soon as it is available.

Targeted Agricultural Modernisation Scheme

Under the Rural Development Programme for the 2014-2020 the following investments have been identified as priority areas to be targeted in the new TAMS scheme:

(i) a young farmer capital investment scheme,

(ii) dairy equipment,

(iii) low emission spreading equipment,

(iv) organic capital investment,

(v) animal welfare and farm safety (specifically beef and sheep handling facilities) farm nutrient storage and animal housing, and

(vi) pig and poultry investments in energy, water meters and medicine dispensers.

I have already launched the new Young Farmer Capital Investment Scheme, the Terms and Conditions of which are available on my Department's website. The remaining TAMS II schemes will be rolled out over the coming months and will be open to all farmers, offering a standard rate of aid of 40%.

GLAS Payments

At the outset, I would like to welcome the fact that almost 27,000 applications were submitted in the first tranche of GLAS applications, which is very much in line with the projections I made when launching the scheme. The level of interest expressed in the new scheme has been remarkable.

I should also say that the prioritisation of farms with clearly identified priority environmental assets is a key component of GLAS, and one which has been broadly welcomed by farmers, environmental NGOs and the European Commission. The identification of priority farmland bird areas on the GLAS system, including Geese and Swans, was informed by the expertise of the National Parks and Wildlife Service, who provided the most up-to-date datasets available.

It is important to note that GLAS is a completely voluntary scheme and the payment rate for this farmland bird action, at €202 per hectare, is designed to take full account of the income foregone by the farmer in complying with the prescription outlined in the GLAS Specification.

That said, an assessment of Tranche 1 of GLAS will be carried out before Tranche 2 is opened in the Autumn. This assessment will look at uptake and issues arising, including the one you have raised. Adjustments to the Scheme, if any, will be on environmental grounds and will be limited given that the overall structure of GLAS has already been approved by the Commission.

Targeted Agricultural Modernisation Scheme

The range of investment items included under the various TAMS measures was informed by the SWOT and needs analyses undertaken as part of the development of the new Rural Development Programme, as well as by an extensive consultation process with the various stakeholders. The funding of sheep fencing did not emerge as a priority from that process. However, I will keep the matter under review.

Agriculture Scheme Eligibility

My Department, in the context of delivering the Single Payment Scheme, Disadvantaged Areas' Scheme and other area-based schemes, is required to carry out a comprehensive set of administrative and on-the-spot checks to ensure scheme eligibility requirements were complied with.

For exclusively owned land, a permanent fence will normally define the area to be measured. However, the situation may be different in the case of hill land. In such situations, if my Department was satisfied that the lands in question continued to be actively farmed in the traditional manner by hill farmers in compliance with the requirements of the EU regulations governing the Direct Payment Schemes, this issue would not arise.

Single Payment Scheme Eligibility

European Council Regulation 73/2009 states that support under the Single Payment Scheme shall be granted to farmers upon activation of a payment entitlement per eligible hectare. An eligible hectare is defined as any agricultural area of the holding that is used for an agricultural activity. An agricultural activity is defined as "the production, rearing or growing of agricultural products including harvesting, milking, breeding animals and keeping animals for farming purposes, or maintaining the land in good agricultural and environmental condition as established in Article 6". Grassland could be maintained in GAEC by conducting an agricultural activity on it, such as grazing, harvesting forage crops, or by topping.

My Department in determining the eligibility of land for aid under the Single Payment Scheme was required to ensure that the above EU regulatory requirements were complied with.

Following the reform of the Common Agricultural Policy, the requirements in relation to land eligibility under the Basic Payment Scheme and other Direct Payment Schemes, contained in the Regulation (EU) No. 1307/2013 of the European Parliament and the Council and Commission Delegated Regulation (EU) No. 639/2014, differ from the requirements under the Single Payment Scheme. The new requirements implemented in Ireland provide that agricultural land must be maintained in a state suitable for grazing or cultivation without preparatory action going beyond usual agricultural methods and machineries.

Bord na gCon Inspections

Bord na gCon is the statutory body responsible for the regulation of greyhound racing under the Greyhound Industry Act 1958. It has specific powers conferred on it by the Greyhound Industry (Racing) Regulations 2007, S.I. 302 of 2007, which set out the detailed rules under which greyhound racing is conducted.

Bord na gCon has confirmed to officials in my Department that its drug surveillance services test for the presence of stanozolol (both oil and water based) and that there have been no confirmed cases of stanozolol reported for Bord na gCon samples to date.

I understand that Bord na gCon is currently finalising a comprehensive review of all aspects relating to integrity, including its sampling and analysis procedures for prohibited substances and medication control.

Following the review, Bord na gCon will consider amendments to legislation to modify practices and policies as appropriate, and assess whether any improvements can be made to the current anti-doping and medication control structures that are in place.

Beef Data Programme

Herd Data

Deputy Éamon Ó Cuív asked the Minister for Agriculture, Food and the Marine if a derogation from the stocking density rule will be provided for new farmers who are waiting for herd numbers under the areas of natural constraint scheme for 2015; particularly the rule that a farmer must have a 0.15 livestock unit per hectare for seven months, given that farmers cannot purchase stock without a herd-flock number; and if he will make a statement on the matter. Under the new Areas of Natural Constraints Scheme introduced under the provisions of Rural Development Regulation (EU 1305/2013), which replaces the previous Disadvantaged Areas Scheme, applicants are required to adhere to certain eligibility conditions.

The new Scheme requires in the first instance that applicants must hold a valid herd number issued by my Department or have applied for a herd number on or before the closing date of the Scheme of 29 May 2015. Furthermore, applicants are required to maintain 0.15 livestock units per forage hectare for a minimum retention period of seven consecutive months in addition to maintaining an annual average of 0.15 livestock units calculated over the twelve months of the scheme year.

Where it has been identified that the holding of an applicant is unable to meet the stocking density requirements due to the date of issue of their herd-number, my Department will review each case individually with a view to confirming the date of application of a herd number and thereafter establishing the earliest possible instance in which a holding would have been able to meet the stocking density requirements. Applicants will be notified in writing of the outcome of the review and in the event that an applicant is dissatisfied with the outcome of that review, they will be afforded the option to pursue the matter to the independent Agricultural Appeals Office.

Agriculture Schemes

Durkan asked the Minister for Agriculture, Food and the Marine if he has received and studied the submission made by the Irish Farmers Association in respect of the operation of various farm support payments, and the concern expressed therein regarding their functionality and applicability; his proposals to address such issues and allay the concerns of the farming community; and if he will make a statement on the matter. I have noted the 'Farm Income Review 2014', copied to me by the IFA earlier this year. Much of the analysis therein reflects similar analysis done by the Department, Teagasc and others in this regard. In relation to the CAP implementation issues which were raised in the Review:

- The Single Payment Scheme was replaced by the Basic Payment Scheme and the Greening Payment in 2015. While all farmers in receipt of payment under the Basic Payment Scheme are eligible for the Greening Payment, the greening obligations apply mainly to arable farmers. My Department worked very closely with the farming organisations, Teagasc, the ACA and individual farmers to introduce a system most appropriate to arable farming in Ireland. An on-line application system was designed to assist arable farmers in ensuring that they were compliant with the greening obligations in their 2015 application. The applications process has now closed and I am satisfied that every assistance was provided to individual farmers during the application period. My Department has now commenced processing the applications with a view to making the Greening advance and balancing payments in October and December respectively.

- The approval of the Rural Development Programme (RDP) was a key priority of mine and following my recent announcement of its approval by the Commission, I have commenced a number of key measures, which will underpin economic growth and development throughout rural Ireland in the years to come.

Bord na gCon is a commercial State body, established under the Greyhound Industry Act 1958, charged with the regulation and development of the greyhound racing industry.

From 1st November 2014 all appointments to State Boards are made through the Public Appointments Service. At present there are four vacancies on the Board of Bord na gCon. My Department and the Board are currently working on role specifications for these posts and when the final specification is agreed, details will be published on the Public Appointments Service website stateboards.ie seeking expressions of interest for the roles. Only the Chairperson of a Board who is being proposed for appointment is required to make themselves available to the appropriate Oireachtas Committee.

I appointed Mr. Phil Meaney as chairman of Bord na gCon in April 2011.

As the Deputy is aware it is Government policy in the case of those being proposed for appointment as chairpersons of state boards, that such persons will be required to make themselves available to the appropriate Oireachtas committee to discuss the approach which they intend to take to their role as chairperson and their views about the future contribution of the body or board in question.

In September 2011 Mr. Meaney made himself available to go before the Oireachtas Joint Committee on Agriculture, Food and Marine for the purposes outlined above but the Committee opted not to meet with Mr. Meaney. This was clarified in a letter to my Department on 3 October 2012 when the Joint Committee advised that they did not require to meet the chairpersons to state boards who had already been appointed by the Minister prior to that date. However, Mr. Meaney has appeared on two occasions in 2014 before the Oireachtas Joint Committee on Agriculture, Food and the Marine on issues relating to Bord na gCon.

My Department and the Board are currently working on role specifications for these posts taking into account the recommendation in the Indecon Report that skill sets of the Board should be enhanced in the legal, marketing and finance areas. When the final specifications are agreed, details will be published on Public Appointments Service website stateboards.ie seeking expressions of interest for the roles.

Regarding the requirement for legal skills I have already appointed a person to the Board with such expertise.

Following the publication of the Indecon Report in July 2014, Bord na gCon submitted an action plan with timelines for implementing the 27 recommendations in the Indecon Report dealing with governance, finance, regulation and welfare.

Bord na gCon has assured my Department that it has assiduously followed up on the undertakings included in its response to the Indecon Report.

As part of complying with the Companies Act 2014 which commenced on 1 June 2015 Bord na gCon have informed me that they intend to re-structure their subsidiaries. This process will be completed by early 2016. During this process the recommendation in the Indecon Report that members of the Board of the Irish Greyhound Board should not also be Board members of IGB subsidiary companies will be addressed.

Bord na gCon has informed me that they are finalising the terms of the tender for internal audit services and advised that the invitation to tender will be available on the Governments procurement website e-Tenders shortly.

Bord na gCon is a commercial State body, established under the Greyhound Industry Act 1958, charged with the regulation and development of the greyhound racing industry.

The Control Committee and the Control Appeals Committee of BNG are established under legislation (Greyhound Industry, Control Committee and Control Appeal Committee Regulations 2007, S.I. Number 301 of 2007).

The Control Committee consists of five members who are appointed by the Board of Bord na gCon. Under article 5 of the legislation establishing the Control Committee and Control Appeal Committee, at least one practising solicitor or practising barrister and at least one veterinarian shall be appointed to the Control Committee from time to time and the term of office of members of the Control Committee shall be three years but retiring members shall be eligible for reappointment.

The existing Control Committee was appointed by the Board on the 29th August, 2013, in accordance with Article 5 of the same legislation therefore their term of office is not due for termination until 2016.
