Heritage Promotion

Deputy Aengus Ó Snodaigh asked the Minister for Housing, Local Government and Heritage the reason that Dublin was removed from the UNESCO World Heritage Organisation tentative list given that Ireland's 2010 list included the historic city of Dublin as a cultural landscape important for its contribution to literature, art, music and architecture; the deadline for inclusion on the tentative list; the reason for the omission or removal of Dublin; when such a decision was made; the way that Dublin will be reinstated on the list; and if he will make a statement on the matter. In line with UNESCO advice that World Heritage Tentative Lists be reviewed at least every ten years, my Deartment launched a call for applications in January 2019 to update Ireland’s World Heritage Tentative List. The Tentative List is essentially an inventory of potential sites that Ireland intends to nominate for inclusion on the World Heritage List. 

My Department's policy is for applications to be sponsored by the relevant local authority or other statutory bodies in order to ensure continuity throughout the process. The role of the local authority is crucial in order to facilitate public consultation and wider stakeholder engagement, particularly in light of the requirement under UNESCO Operational Guidelines for participatory planning and stakeholder consultation.

In December 2018, prior to the launch of the call for applications, and again in July 2019, my Department contacted the Chief Executive Officers of each of the County or City Councils involved with properties on the 2010 list to advise that the list was under review. My Department also organised outreach events including facilitating two World Heritage Workshops, in conjunction with ICOMOS Ireland.

My Department received the following six applications for inclusion on a new Tentative List by the deadline of 30 June 2021, as follows: 

1. The Cultural Landscape of the Burren Uplands, County Clare;

2. Iniscealtra (Inis Cealtra / Inishcaltra / Holy Island), County Clare;

3. Trans-Atlantic Cable Ensemble: Valentia, County Kerry &Heart's Content, Newfoundland, Canada;

4. The Royal Sites of Ireland; 

5. The Passage Tomb Landscape of County Sligo; and 

6. Glendalough Valley, County Wicklow.

No application was received in respect of the Historic City of Dublin, in effect removing itself from consideration for the tentative list.

I established an independent Expert Advisory Group (EAG) to evaluate each of the applications received based on their ability to demonstrate Outstanding Universal Value (OUV), integrity, authenticity, long-term protection and management frameworks, and evidence of local stakeholder support - all critical components of a future nomination dossier. 

I intend to make an announcement on the composition of a new Tentative List for Ireland in July.  Only those sites whose applications clearly demonstrate potential OUV will be included on the new Tentative List.

It is envisaged that Ireland’s Tentative List process will be reopened for review within the next five years to allow my Department assess other sites that may be proposed and which may demonstrate OUV. This may include sites on the 2010 Tentative List for which applications were not submitted under the current Tentative List review.

Building Regulations provide for the health and safety of people in and around buildings.  Part L of the Building Regulations provide for the Conservation of Fuel and Energy. Part J of the Building Regulations provide for Heat producing Appliances.   All new dwellings must comply with all parts of the building regulations.  

Part J of the Building Regulations sets out the legal requirements in relation to the provision of chimneys and flues in dwelling houses, while Technical Guidance Document J - Heat producing appliances (TGD J), provides the necessary technical guidance indicating how the requirements of Part J can be achieved in practice.

A "heat producing appliance" means a fixed appliance (including a cooker and an open fire) which is designed to burn solid fuel, oil, bio-fuel or gas and includes an incinerator.

When a heat producing appliance is being installed, it must have adequate provision for the discharge of the products of combustion to the outside air, usually achieved by the installation of a chimney or flue. The provisions for the discharge of the products of combustion to the outside air via chimneys or flues and the associated ventilation requirements for a range of heat producing appliances, and fuel types, are given in Sections 1, 2, 3 & 4 of TGD J.

When no heat producing appliance is being installed in the dwelling house, there is no mandatory requirement to construct a chimney or flue, however, the provision of a chimney in a dwelling house, where none is required, is not precluded by the Building Regulations.

There are no proposals to amend Part J to obligate building owners to install chimneys or flues in new houses.

Part L sets the energy and carbon performance for dwellings and is performance based. It is a matter for the specifier/designer to specify the heating system to achieve compliance with Part L.

 The Nearly Zero Energy Buildings requirements of the building regulations make it more attractive for builders and homeowners to further incorporate renewable technologies and move away from traditional fossil fuels. The Central Statistics Office analysis of Building Energy Rating data demonstrates this shift away from fossil fuels; oil boilers are no longer installed in new dwellings, and heat pumps make up 80% of heating systems in new dwellings with this percentage growing steadily each year. All new dwellings typically have an A rated Building Energy Rating.

The implementation of Nearly Zero Energy Buildings through our building regulations will ensure that whilst we achieve more energy efficient buildings we also build warmer, more comfortable, healthy, sustainable and durable buildings suitable for the Irish Climate both today and into the future.  This will contribute Ireland's ambition to provide for a reduction in emissions of 51% by 2030.

My Department is leading implementation of the process to expand Ireland's network of marine protected areas (MPAs) and the associated commitments in the Programme for Government, namely:

(1) to develop comprehensive legislation that will enable MPA designation and management, and

(2) to realise Ireland's outstanding target of 10% MPA coverage of our waters as soon as is practical, aiming for 30% coverage by 2030.

This work is being carried out in close and extensive consultation with other Departments and Agencies, with maritime stakeholders, coastal communities, representative organisations and with the wider public.

The process underpinning this work began with the convening in October 2019 of an expert advisory group to provide independent advice and recommendations on the expansion of Ireland’s MPA network. The resulting comprehensive report of the advisory group was developed during 2020 and published bilingually in January 2021. This report which includes the results and findings from a series of stakeholder consultations undertaken by the advisory group was subject to a wider public consultation from February to Jul 2021.

Informed by the experts' advice and recommendations, and by detailed feedback from over 2,300 submissions received from the public consultation, my Department now intends to commence work on the necessary legislation for an expanded network of MPAs. Work on the General Scheme of an MPA Bill will continue into the autumn of 2022, with the aim of enacting the legislation in 2023.

I refer to the reply to Question 243 of 19 May 2022 and the information provided on the water quality issues with Kilteel Group Water Scheme. 

My Department's Rural Water Programme provides capital funding under a multi-annual programme and an annual subsidy for the operational and management costs of group water schemes providing water for domestic use. The funding under the Programme is particularly focused on helping group water schemes to achieve wholesome and clean drinking water that is safe to drink on a consistent long-term basis by being compliant with the Drinking Water Regulations.

My Department is responsible for policy while the day to day management of the Programme is devolved to the local authorities. I understand that Kildare County Council, as the supervisory authority under the Drinking Water Regulations for private water supplies, are continuing to actively work with the Kilteel supply to sustainably resolve their water quality issues.

Each local authority has appointed a Rural Water Liaison Officer (RWLO). The RWLO deals with the day to day issues for the Programme and can be contacted at the local authority offices.
