Vol. 9 No. 22

WRITTEN ANSWERS. - AUXILIARY POSTMAN'S UNEMPLOYMENT CLAIM.

asked the Minister for Industry and Commerce whether he is aware that Mr. McCloskey, of Riverstown, County Sligo, who has been employed as an Auxiliary Postman, has been informed that he is not entitled to Unemployment Benefit, although he is now employed three days in the week, and has his card fully stamped, and whether he can state the grounds on which this decision was taken.

In order to qualify for the receipt of Unemployment Insurance Benefit it is necessary for a claimant to prove that he is continuously unemployed. Continuous unemployment for the purposes of the Unemployment Insurance Acts is defined in Section 7 (2) (B) of the Unemployment Insurance Act, 1920, as amended by Section 3 (3) of the (No. 2) Act, 1921.

From inquiries which I have made in the case of Mr. J. McClosky, Ardcomer, Riverstown, Co. Sligo, to whom it is presumed the Deputy's question refers, I understand that Mr. McClosky is employed on alternate days in each week, and in these circumstances it would not be possible for him to prove continuous unemployment within the meaning of the Acts. In these circumstances he cannot qualify for the receipt of Unemployment Insurance Benefit.
