asked the Minister for Local Government and Public Health if he will state what is the fruit content of jam for the purposes of the Food and Drugs Acts.

There is no statutory standard for jams in this country, nor is there any enactment empowering the fixing of such standard. The genuineness of a particular commodity as jam or as a certain kind of jam would be governed by Section 6 of the Sale of Food and Drugs Act, 1875, which provides that no person shall sell to the prejudice of the purchaser any article of food which is not of the nature, substance and quality demanded by such purchaser, and in the case of a prosecution it would, accordingly, be a matter for the court to decide whether on the evidence before it there had, in fact, been a breach of the law.
