asked the Minister for Local Government if he will state the provisions of the Labourers Acts which correspond to section 115 of the Housing Bill, 1965.

asked the Minister for Local Government if he is aware that the scope of section 115 of the Housing Bill, 1965 appears to be very much wider than section 88 of the Act of 1890 (ch. 70) inasmuch as the said section 88 relates to parts one and two but not part three of that Act; and if he will expand his explanation of 30th November, 1965.

With your permission, a Cheann Comhairle, I propose to take Questions Nos. 17 and 18 together.

Section 115 of the Housing Bill does not correspond to any provision of the Labourers Acts but section 92 and the First Schedule of the Housing of the Working Classes Act, 1890, and section 23 of the Housing (Amendment) Act, 1950, in effect, made county councils the local authorities for the purposes of Parts II and I, respectively, of the Act of 1890, to which section 88 of that Act relates. Section 115 of the Bill is based on section 88 which prohibits members from voting on any resolution or question arising under Parts I or II of the 1890 Act if it relates to a house or land in which they are beneficially interested.

The property qualifications for membership of local authorities existing when the 1890 Act was passed made superfluous the application of section 88 to Part III of the Act, dealing with the provision and management of working class dwellings. These qualifications no longer exist, and section 115 of the Housing Bill, 1965, accordingly applies to any resolution or question arising in pursuance of the Bill, including matters corresponding to Parts I, II and III of the 1890 Act.
