Vol. 275 No. 4

Ceisteanna—Questions. Oral Answers. - Property Damage Compensation.

49.

Mr. McLaughlin

andMr. Gilhawley asked the Minister for Local Government if compensation will be paid to the residents of Kiltyclogher, County Leitrim, whose property was damaged by the blowing up of Border bridges by the British Army.

Where a person claims in court for compensation for damage to property under the malicious injuries code and the court awards a decree for the damage, the decree is payable by the local authority, and the cost to the local authority of meeting such a decree is recoupable by the Exchequer where, in the opinion of the chief superintendent for the area, the damage was caused by the use of explosives and is attributable to the disturbance in Northern Ireland.
