Proinsias De Rossa

Ceist:

125 Proinsias De Rossa asked the Minister for the Environment , in respect of legislation passed under the aegis of his Department, which required (a) a ministerial order or (b) an order of the Oireachtas to implement (1) the entire Act or (2) any section of the Act, he will list any Act or section of an Act which has not yet been implemented; and the reason for any such non-implementation.

The following provisions have not been brought into operation: Local Government Act, 1955 (No. 9 of 1955): sections 61 and 62. Road Traffic Act, 1961 (No. 24 of 1961): sections 93 and 127. Local Government (Planning and Development) Act, 1963 (No. 28 of 1963): sections 86, 87 and 88 and section 92 (5). Road Traffic Act, 1968 (No. 25 of 1968): sections 21, 58 and 61. Housing Act, 1966 (No. 21 of 1966): section 115. Local Government (Water Pollution) Act, 1977 (No. 1 of 1977): sections 25 and 34. Air Pollution Act, 1987 (No. 6 of 1987): sections 20, 21, 22, 23 and 25. Housing Act, 1988 (No. 28 of 1988): section 8. Building Societies Act, 1989 (No. 17 of 1989): Part IX.

The provisions of the Local Government (Planning and Development) Act, 1963 listed above are due to be superseded by relevant provisions of the Building Control Bill, 1988, which is at present before the Seanad.
It has not been found necessary/ appropriate to date to activate the other provisions listed above having regard to matters on which their operation is contingent.
