Ceist:

114 Mr. Durkan asked the Minister for Agriculture and Food, having regard to his reply to Parliamentary Question No. 88 of 13th March, 1990, if the deed of trust referred to has operated continuously since 1904; if so, the procedures to be followed; whether a new trust will be set up or whether the old trust may be revived; and if he will make a statement on the matter.

115 Mr. Durkan asked the Minister for Agriculture and Food, having regard to his reply to Parliamentary Question No. 88 of 13 March 1990, when the lands in question became the responsibility of the trustees; when the deed of trust was drawn up; if reference was made to the rights of any other interested party in the drawing up of the deed of trust; if he has received any communication to the effect that other interests may have a claim to the lands in question; and if he will make a statement on the matter, having regard to the fact that the trust in this case did not exist for several years.

I propose to take Questions Nos. 114 and 115 together.

According to the records in my Department the lands in question passed to the trustees under deed of trust dated 4 August, 1904. The rights and duties of the parties are set out in the trust deed. It is understood that a claim to part of the lands was the subject of litigation some years ago. The other information requested by the Deputy is not a matter for my Department.
