84 Mr. Ellis asked the Minister for Social Welfare the position regarding the old age pension appeal of a person (details supplied) in County Leitrim.

The application of the person concerned for an old age non-contributory pension was rejected as his means — derived from a holding and capital — exceeded the statutory limit for entitlement to pension.

Following an appeal to the independent social welfare appeals office, the appeals officer examined his case on 29 April 1991 at an oral hearing at which the person concerned gave evidence. The appeals officer determined on 28 May 1991 that the appeal could not be allowed. The person concerned was notified of the decision on 4 June 1991.

The decision of the appeals officer is final and conclusive except in the light of fresh evidence or new facts.
