88 Mr. Kenny asked the Minister for Justice his views on whether it is appropriate that citizens who assist in the prevention of crime and who have their vehicle damaged as in the case of a person (details supplied) are not liable for any insurance compensation; and if he will make a statement on the matter.

A procedure exists whereby, depending on the circumstances, my Department, with Department of Finance approval, may pay compensation on an ex gratia basis in situations of this kind.

However, the particular case to which the Deputy refers happened less than a fortnight ago. It is still being investigated and no compensation claim has yet come to hand from the injured party. Any such claim will be considered on its merits in the light of the Garda report of the incident concerned.
