Vol. 415 No. 1

Written Answers. - Asylum Seeker Procedures.

Seán Barrett

Ceist:

285 Mr. S. Barrett asked the Minister for Justice if, in relation to those seeking asylum in this country, he will outline, (a) the procedures at present in force for dealing with asylum seekers, (b) the way in which the requirements of due process are guaranteed, (c) the statutory instruments, if any, dealing with procedures for asylum seekers, (d) where information regarding the administrative procedures in force for dealing with asylum seekers is to be found, and if it is publicly available, (e) whether asylum seekers have a right of appeal against a decision, and if so, the appeals procedure that is available, (f) whether legal aid is available to any asylum seekers, by right or otherwise, (g) the primary national and international legislation governing the handling of asylum requests and the treatment of asylum seekers and, (h) whether asylum seekers are subject to compulsory finger printing, and if not, whether such a measure is under consideration, or has been considered in inter-Government meetings in which Ireland has participated.

I have outlined the requirements and procedures to be followed with regard to those seeking asylum in previous replies to parliamentary questions (column 2556 of the Official Report of 14 June 1990 and 1280 of the Official Report of 14 March 1991).

Asylum seekers may apply for legal aid under the scheme of civil legal aid and advice. They are not subject to compulsory fingerprinting and I have no plan to introduce such a requirement.
