Written Answers. - Child Sexual Abuse Allegations.

Ceist:

142 Ms O'Donnell asked the Minister for Justice if she has satisfied herself that adequate action was taken in relation to an allegation of sexual abuse of a child (details supplied) in County Mayo to which the abuser made a confession and in which a decision was made not to prosecute; if the person is being monitored; and if so, if she is being monitored under a juvenile diversion programme; and if she will make a statement on the matter. I am informed by the Garda authorities that the case was fully investigated by the Garda and a file submitted to the Director of Public Prosecutions who, having considered the matter, directed that proceedings should not be instituted. The file was subsequently resubmitted to the DPP to clarify the position as to a caution under the juvenile diversion programme. The DPP stated that, as there was insufficient evidence to warrant a prosecution, the question of a caution under the programme did not arise.
