516 Ms F. Fitzgerald asked the Minister for Enterprise and Employment the Acts and provisions of Acts under the auspices of his Department which, as of 1 January 1996, are not in force in view of the fact that a commencement order has not been made; whether it is proposed to make such an order in each case; and if so, when. [19409/96]

In the time available, the following information has been prepared in response to the Deputy's question.

The following Acts, or provisions of Acts, were not in force as at 1 January 1996 because a commencement order had not been made:

Dangerous Substances Act, 1972 as amended by section 1 of the Dangerous Substances (Amendment) Act, 1979

Part 2 — sections 7 (i) and 7 (ii) and sections 9-19

Consumer Credit Act, 1995

Entire Act

Companies Act, 1963

Section 195 (8) (as inserted by section 51 of the Companies Act, 1990)

Companies Act, 1990

Sections 248 and 249

In relation to the Consumer Credit Act, 1995, it is my intention to make a commencement order in the coming months. No decision on making a commencement order has been taken in respect of the other Acts, or provisions of Acts, as outlined above.
