Written Answers. - Delisting of Judge.

127 Mr. Lawlor asked the Minister for Justice if she will give details of any internal memoranda which were sent to her regarding the delisting of Justice Dominic Lynch in the period between Justice Lynch's first letter requesting delisting and the Attorney General's second letter to her. [23445/96]

Judge Lynch originally wrote to me in July 1995 requesting that he be relieved of his membership of the Special Criminal Court panel but kindly agreed at that time to remain on the panel. Judge Lynch subsequently made a request to be removed from the panel on 2 July 1996. Following receipt of this letter, a draft letter of acknowledgement was submitted to my office but I returned this to the courts division with a request to see earlier papers as I was considering Judge Lynch's request. In July, after receipt of Judge Lynch's letter, a draft memorandum for Government was also prepared in the courts section but was not finalised. This matter is dealt with at page two of the Report of the Inquiry into the delisting of Judge Dominic Lynch from the Special Criminal Court panel. A new draft memorandum was sent to me by the courts division of my Department on 30 July 1996 in connection with the delisting of the judge. This was accompanied by a covering note requesting my approval for action. I authorised this memorandum to be submitted to Government and it was approved at the Government meeting on 1 August 1996.
