297 Mr. Callely asked the Minister for the Environment and Local Government when the report of the public inquiry for the Dublin port tunnel motorway scheme will be considered by him; and if he will make a statement on the matter. [19016/99]

Mr. R. Bruton asked the Minister for the Environment and Local Government if he has received the report of the inspectors of the port tunnel; if he will issue this report to interested parties prior to making a decision; when he will make a decision; if there are further reviews of this decision possible in the European Commission or before the courts; and if he will make a statement on the matter. [19020/99]

I propose to take Questions Nos. 297 and 301 together.

The inspectors' report on the public local inquiry into the Dublin Port tunnel motorway proposal and related toll scheme is now with my Department. In accordance with the normal practice of my Department, the report will only be made available, on request, immediately following the determination of this case. I can assure the Deputies that I will determine the issues involved in this case as quickly as possible.

Section 6 of the Roads (Amendment) Act, 1998, sets out conditions under which applications may be made for judicial review of orders made by me in relation to motorway schemes and environmental impact statements; the section also provides that before any case can proceed the High Court must be satisfied that there are substantial grounds for seeking review of the order concerned.
