Ceist:

112 Mr. Ring asked the Minister for Agriculture, Food and Rural Development if a REP scheme penalty imposed on a person (details supplied) in County Mayo will be reduced to a more reasonable amount in view of the minor offence involved and the fact that the farm is located in a disadvantaged area; and if this case will be reviewed on compassionate grounds. The person named has lodged an appeal with my Department against a 10% penalty imposed on his REPS payment. The appeal is being examined by my Department's inspectors and when their report is available, the matter will be referred to the REPS appeal committee for a decision. The applicant will be informed of the outcome directly in writing.

113 Mr. G. Reynolds asked the Minister for Agriculture, Food and Rural Development if, further to Parliamentary Question No. 110 of 20 April 2000, his Department has any further information in regard to the entitlement of the person concerned to headage and suckler cow grants; and if he will make a statement on the matter. [16275/00]

As stated in my reply to Parliamentary Question No. 110 of 20 April 2000, the applicant included commonage in his 1999 area aid application but did not proivde proof of his entitlemetn to a share of the commonage. As the applicant was unable to provide such proof, my Department requested a search of the records of the former Land Commission. This search has been completed and we have contacted the person named in order to finalise the matter.
