Brendan Howlin

Ceist:

583 Mr. Howlin asked the Minister for Justice, Equality and Law Reform the status of an application for asylum by a person (details supplied) in County Kilkenny; and if he will make a statement on the matter. [12002/02]

The applicant arrived in the State on 17 December 2000. His claim was refused by the Refugee Applications Commissioner on 4 July 2001 and he was notified of this decision on 3 August 2001. The applicant appealed this decision on 27 August 2001. On 25 January 2002 the Office of the Refugee Appeals Tribunal rejected his appeal and he was notified of this decision on 19 February 2002.

In accordance with section 3 of the Immigration Act, 1999, the applicant was informed on 15 March 2002 that it was proposed to make a deportation order in his case. He was given the alternatives of either making representations within 15 working days setting out the reasons why he should be allowed to remain temporarily in the State, leaving the State before the order was made or consenting to the making of a deportation order. Representations were received as to why he should be allowed to remain in the State. I expect the case in relation to the applicant in question to be submitted to me for decision shortly.

Billy Timmins

584 Mr. Timmins asked the Minister for Justice, Equality and Law Reform the position regarding persons (details supplied) in County Wicklow who have been informed that their appeal for refugee status has been unsuccessful; if there is a further appeal open to them as they have been promised employment in the area; and if he will make a statement on the matter. [12008/02]

The applicants arrived in the State on 28 April 2000. Their claims were refused by the Refugee Applications Commissioner on 28 November 2001 and they were notified of this decision on 10 and 11 January 2002 respectively. The applicants appealed these decisions on 16 January 2002. On 13 March 2002, the Office of the Refugee Appeals Tribunal rejected their appeals and they were notified of these decisions on 22 March 2002.

In accordance with section 3 of the Immigration Act, 1999, the applicants were informed on 11 April 2002 that it was proposed to make deportation orders in their cases. They were given the alternatives of either making representations within 15 working days setting out the reasons why they should be allowed to remain temporarily in the State, leaving the State before the orders were made or consenting to the making of deportation orders. I am currently awaiting representations by or on behalf of the applicants.
