Ceist:

108 Mr. Carey asked the Minister for Finance if a person (details supplied) in Dublin 11 should be paying income tax; and if he will make a statement on the matter. [12431/03]

I am informed by the Revenue Commissioners that, as the taxpayer reached the age of 65 during 2002, he is eligible for the age exemption limits, which are €26,000 in 2002 and €30,000 in 2003 and which apply to married taxpayers aged 65 or over. He is not, therefore, liable to pay income tax in 2002 and 2003. It is understood that €964.90 in income tax was deducted from the taxpayer's pension during 2002. Arrangements are being made to refund the full amount deducted.

I am further informed that an exemption certificate has been issued for 2003. The Department of Defence will implement this certificate with effect from the taxpayer's next pension payment date, that is, 20 May 2003, and all tax deducted from the taxpayer's pension since 1 January 2003 will be refunded on that date.
